69R-373 RESOLUTION NO. 69R-373 A RESOLUT ION OF 'rHE CITY COUNCIL OF THE CITY OF ANAHEIM GI~TING VARIANCE NO. 2083 WHEREAS~ the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from Gene Jenkins, agent fo~Grand Marnier Co., owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: All that certain land situated in the state of California, County of Orange, City of Anaheim, described as follows: That portion of Lot 13 of Helen & Lynch's Sub- division, as shown on a Map recorded in Book 442, page 158 of Deeds, Records of Los Angeles County, California, described as follows: Parcel I as shown on Map filed in Book 9, page 5, of Parcel Maps, records of said County, less the North 50 feet thereof. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on _ Mq,\j 19 lq69 , notice of which said public hearing was duly gl en as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, lnvestigatJon and studies made by itself and in its behalf, and after dlJe r.:onsideration of all evidence and reports offered at said hearing. did adopt Resolution No. pc69-l04 npnying.o______ Variance No. 208.J.______ ; and ---"--"'-"-~-'--''''-- '--'--"--<--" ._--~...._..,_...,-----_...~-_._--------- WHEREAS ,the!:'eafter, 'Vli thin twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the Clty Planning Commission denyinq said variance, and said appeal was set, for public hearing on June 24 L9 69 , at 1:30 o'clock P.M. at the City Hall in the City of l'llaheim, and notice of such public hearing was duly given as required by taw and thE:: p.rovisions of Title 18, Chapter 18.76 of the Anaheim MunicipaL Code; and -. 1.-' \'<JIIEREAS, after due Investlgat.1.0n and studies made by Itself and In Its behalf, and after due consideration of all the evidence and reports offered at saId hearing, the City Councl1 does find and determine that: 1. There are exceptional or extraordinary circum- stances or conditIons applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same viCInity and zone. 2. That such a varIance is necessary for the preser- vation and enjoyment of a substantial property rIght possessed by other property in the same viCInity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in suoh vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan, NOh', THEREFORE, BE IT RESOLVED by the City Council of the CIty of AnaheIm that a cond1.tional zoning variance be, and ~he same is hereby granted authorizing the free-standing sign at the corner and the menu and order box sign only, which menu- order box sign is to be cut off at the top of said sign, and the balance of the projected sign is denied, with waivers of the following Anaheim Municipal Code Sections: 1. Section l8.62.090(B-l) - number of free-standing signs; and 2. Section l8.62.090(B-l) - distance between free- standing signs. That this variance is granted subect to the following condition: That subject property shall be developed sub- stantially in accordance with plans and speci- fications on file with the City of Anaheim, marked Exhibits Nos. 1, 2, 3, 4, and 5 as revised. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, its heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Iclunicipal Code unless otherwise specified herein. THE FOREGOING RESOLUTIO~,is approved and signed by me this 24th day of June, 1969.
