69R-371 RESOLUTION NO. ~9R-371 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRAN'l'ING VARIANCE NO. ~.093 ~mEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from Apollo Development ~orporation agent for Seventh Day Adventists, owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: PORTION A The East half of the Southeast quarter of the South- west quarter of Section 13, Township 4 South, Range 10 West, San Bernardino Base and Meridian. EXCEPTING therefrom the North 665 feet. ALSO EXCEPTING THEREFROM the Southerly 203 feet of the Easterly 265 feet. ALSO EXCEPTING THEREFROM that portion described in the Deed to the County of Orange, recorded March 23, 1967 in Book 8206, page 203 of Official Records, in the Office of the Recorder of said Orange County. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on June 2. 1969 , notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due ~nspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. PC69-133 denying Va~iance No. 2093 --~-~-'---'._--_._--'-"-~ and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed wlth the City Council of the City of An~1eim protesting the action of the City P lannl.ng Commission denying said variance, and said appeal was set for public hearing on June 24 19 69 , at L30 o'cl:..;ck PoM. at the City Hall in the C.1ty of Anaheim, and notice ()f such pUblic hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and , - L'- "'"""~"'""""_' d.. _,~,_,'_. _._ .,~. _ .., 'I'._."K".--."'._.__,_........__,.,._~..'^_~ lJIIEREAS, after due ~nvestlgat.ion and studies made by Itself and 1n Its behalf, and after due consideration of all the evidence and reports offered at sald hearlng, the City Council does find and determine that: 1. There are exceptional or extraordinary circum- stances or conditlcns applicable to the property lnvolved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance lS necessary for the preser- vation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or inJurious to the property or improvements in such vicinity and zone 1n which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. Nmv, THEREFORE, BE IT RESOLVED by the City Council of the CIty of AnaheIm that a condItional zoning variance be, and t~e same lS hereby granted authorizing the establishment of a 196-unit apartment complex on PORTION A hereinbefore described with waivers of the following Anaheim ~iunicipal Code requirements or limitations: 1. :vlaximum number of main buildings on a site, Section 18.32.020 (1); 2. Maximum builciing height "vi thin 150 feet of R-A or Single-Family zoned property, Section 18.28.050 (5-b); 3. Location of accessory buildings, Section 18.28.050 (6-b-3); 4. l\:linimum distance bebveen buildings, Section 18.28.050(7-a); and 5. i\ilinimum number of required covered parking spaces, Section 18.28.050(lO-a). 'J.'hat this variance is granted subject to the follmving conditions: 1. That this variance is granted subject to the completion of Reclassification No. 68-69-97. ") ... . That in tne event subject property is subsequently split for purposes of sale or financing, a Parcel i-lap to record the approved division of subject property shall be sUDmittea to the City of Anaheim for approval and tnen recorded in the Office of the Orange County Recorder, and a mutual easement agreement for co~non drives shall be submitted to the City Attorney for a?proval. -2- ......_.......c..~~",_>==,___..,~._... _....,._~..-""""______...__ 3. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit No.1, Revisions Nos. 1, 2 and 3. 4. That a masonry wall snaIl be constructed along the north and west property line at the rear of carports similar in design and decor to the existing wall along Sunkist Street. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, its successors or assigns, to comply with the Anaheim l'lunicipal Code and regulations and the conditions herein.
