'ihe proponents in applications which ere not contested will have five minutes to present their evidence. Additional time will be granted upon request il, in the opinion of the Commission, such additional time will produce evidence Important to the Commission's consideration. 2. In contested applications, the proponents and opponent will each be gh•en ten minutes to present their case unless additional time is requested and the complexity of the matter warrants. Commissioner Henninger noted staff is recommending approval for an additional five (5) years and Mr. Page agreed five years would be acceptable. Chairwoman Boydstun clarified that these would be small private trucks and that they would be doing goneral maintenance on the vehicles. Commissioner Messe asked about the vehicles which he saw currently on the property. Mr. Page explained the Laura Scudder's Potato Chip's operation is in the front unit and that his vehicles will all be inside at night, except for his personal boat which he stores on the property. OPPOSITION: No one was present/Correspondence was received in opposition PETITIONER COMMENTS Glenn Hellyer, agent, explained this site was previously a gas station with auto repair and the tanks have been removed and the Code requires a nevv conditional use permit for automotive repair. THE PUBLIC HEARING WAS CLOSED. Commissioner Messe referred to stall's recommendation regarding removal of the overhead canopy. Mr. Hellyer responded this site has been empty for number of years and that they would seek relief on some of the recommended conditions because the amount of rent they will receive would not warrant making some of tftuse costly improvements. He recognized the desire to eliminate auto repair under the canopy in front and they would be willing to remove the canopy; however, the driveways are very costly to remove. He stated this use wi~l be less intense than the gas station with auto repair that was previously approved and ihey are not adding anything to the building. The lease is for three (3) years. Agreed to remove the pole sign in the future and to remove the canopy if that is the wish of the Commission. Commissioner Henninger asked if the driveways could be blocked without reconstructing them. Alfred Yalda responded if they could be phys(cally block with landscaping, that would be acceptable. Mr. Hellyer agreed to continue the landscape pl:.~ters across the driveways, sub)ect to the approval of 'fraHic Engineering. Commissioner Henninger suggested approval for 3 years. 10.31-94 Page 7 ~~ Commissioner Messe thought the driveway on Westport would not present a problem and suggested it could s .:y open. Chairwoman Boydstun agreed. Mr. Yalda explained at signalized intersections, they review the accident history for five years and base their recommendation on that history and the history on this intersection was reviewed from 1987 to 1994. He pointed out that intersection is not aligned properly as well. Mr. Hellyer agreed to blocking both driveways by continuing the landscape planters. He also agreed to change the landscape plans as suggested by staff and replace proposed palm trees adjacent to State College with a more substantial tree species. Mr. Hellyer stated Engineering staff has identified three sections of sidewalk which needs to be repaired and they are prepared to do that as long as they don't have to reconstruct the whole sidewalk. Melanie Adams, Associate Civil Engineer, agreed that ~or~dition No. 5 cou!a be modified to reeid that damaged sections of sidewalk should be repaired, to tr,,; satisfaction of the City Engineer. Jonathan Borrego asked that Condition No. 1 be modified to include that the canopy and the poles supporting it would be removed. Commissioner Peraza stated th•~ Commission received a letter from the people directly adjacent indicating they do not feel this is a good place for an auto repair facility. ACTION: Approved Negat(ve Declaration (Findings in Paragraph 12 of staff report) Waiver of Code requirement was denied on the basis that it was deleted following public notificafion. Granted Conditional Use Permit No. 3725, in part, for a period of 3 years (Findings in Paragraphs IB and 19), subject to Condition Nos. I through 11 of the staff report, except as follows: Modified Condition Nos. 1, 2 and 5 to read as follows: 1. That the existing service station canopy (including its support posts) and the sign pole shall be completely removed. 2. That the existing driveways nearest the intersection of Westport Drive and State College Boulevard shall be blocked by the installat(on of on-site landscape planters and landscaping. 5. OPPOSITION: None Glenn Noreen explained this proposal involves moving their Yorba Linda campus to Anaheim; that it is preschool through elementary school now and they have applied for preschool through jr. high because they would the flexibility of adding jr. high in the future. They will end up with 450 students at this campus and it looks like a very good complimentary use to the Vineyard Church. Their high use is during the week and Vineyard's high use is on weekends. CLOSED THE PUBLIC HEARING. Chairwoman Boydstun asked if the Vineyard Church is closing their preschool and Mr. Noreen responded they are actually expanding and they are moving Fairmont out of the area they are currently using and this new building will be a permanent location. ACTION: Approved Negative Declaration (Findings in Paragraph 17 of the staff re^~~rt) Granted Conditional Use Permit No. 3726 (Findings in Paragraphs 22 arn1 23 0( the staff report, subject to Condition Nos. 1 through 6, pages 7 and 8 of the staff report, and Added the following condition: That school enrollment shall be limited to four hundred fifty (450) students. REQUEST TO DETERMINE CONFORMANCE WITHIN THE Determined that the GENERAL PLAN FOR THE PROPOSED LEASE OF OFFICE SPACE use is in conformance FOR THE COUNTY SOCIAL SERVICE AGENCY: John Bordeaux with the Anaheim County of Orange General Services Agency, Real Estate Division, 14 General Plan Civic Center Plaza, Third Floor, P.O. Box 4106, Santa Ana, CA 92702 request to determine conformance within the general plan for the (Vote: 7-0) proposed lease of office space and the property is located at 900 East Vermont Avenue. William Rawlings, representing County of Orange, explained the proposal is to relocate the Homer Street Welfare facility to 901 East Vermont. Slides were presented and the fo~lowing points were made: a. In the Spring of 1993, the City and various Homer Street area community groups approached the County and requested that that facility be relocated because of perceived concerns and negative impacts in the community. b. Homer Street facility is a 3-building complex, approximately 46,000 square feet; one building is leased, two are owned. c. Homer Street parking is inadequate. d. Facility is very old. e. Programs operated out of Homer Street facility, predominantly are SSA and they occupy a majority of the facility and provide general relief and food stamp services. i. Daily average number of clients at Homer Street is approximately 220. g. Majority of clients are single adult men and remainder are mostly adult females and there are some children served at this facility. h. District Attorney, Welfare Fraud Division, and the Health Care Agency occupies a small portion of the facility. i. Services provided are crucial to the citizens of Anaheim and speciticaily the central Anaheim area. j. There is a small number of clients who may come from outside the Anaheim city limits, but vast majority are citizens of not only Anaheim, but central Anaheim. k. County is mandated to provide these services and also to provide them in the central Anaheim area, within a reasonable geographic distance from the population. I. Issues addressed by City staff, as well as the community groups, and the County has identified these as problems include: t. inadequate parking for both staff and public 2. vastly too small lobby and waiting areas, and poor configuration of the facility resulting in slow service which results in people waiting an inordinate amount of time County real estate holdings and background comments, to explain why they feel strongly that this site is going to work well for them include: t. County leases approximately two million square feet of building space. 2. Total rent is over 522 million annually 3. Type of'.acilities Include Aids Clinics, Methadone Clinics, Mental Health Clinics, Alcohol and Drug Abuse Clinics, Maternal and Child Health Clinics, Probation offices, Probation Drop-In Center, Immunization Clinics, Financial Aide Offices, and General Relief Offices such as the proposed facility. 4. Over last 5 years, been very successful in locating and relocating these types of potentially controversial uses into various communities throughout the 10.31.94 Page 10 i county, not Just in Anaheim, and have been able to significantly reduce not only the actual Impacts to the community but the perceived Impacts in the community by working closely with various citizen groups. They make every effort to provide state of the art systems and facilities, above standard parking on site, above sized lobbies with sufficient square footage, continuous onsite security provided by County Sheriff's Department, pleasant landscaping and architecture and aggressive vandalism deterrents and feel i this contributes to a vast reduction of perceived problems. 6. Showed Financial Aide office in Garden Grove on Brookhurst, the rear of the facility. 7. Entrances to all their facilities are located in the rear, and they find that allows them to shift whatever impact there is in the community to the rear of the facility so it doesn't Interfere with surrounding area or traffic and also gives them better proximity to parking. S. 2060 Santa Cruz Financial Assistance Office, with refugee assistance and relocation, rear of facility with abundant parking, entrance in the rear 9. Mental laealth and Drug Abuse Clinic located in Suuth County, across the street from a preschool, and they had concurrence with the opening of the I facility and they have actually endorsed it and have received no complaints or concerns t0. La Palma Financial Assistance facility, rear entrance, secured parking for staff, abundant parking, close proximity to Camelot Family Fun Center and contrary to any negative impact, Camelot has actually increased the size of their lunch area to accommodate the increased traffic slow in the area and thought (t has increased business from their staff and clients. 12. Eckoff Facility in Orange, SSA Children and Youth Services, similar to the 901 East Vermont facility 13. South Grand Financial Assistance/Welfare Office, Industrial tilt-up construction, new facade, glass, brick work, landscaping along the street and attractive wrought iron fencing. t4. Fear of Grand facility, parking lot is approximate size of one proposed, entrance at the rear. A. Hom er Street facility -cars parked on grass, cars double parked. Rear of 901 E. Vermont facility, more than adequate parking and will be reconfigured with striping, additional landscaping, and that will effectively solve the parking problem. Lobby Area at Homer Facility which is actually a hallway and wholly inadequate. La Palma facility lobby area with adequate seating and nicer facility. Front of Homer Facility now Vermont Facility now and what they want to do to improve it, new facade, paint scheme, attractive wrought iron fencing for security, and an abundance of additional landscaping. Surrounding area of Vermont site, to the west a rail line and an industrial building, to the east a tow yard/junk yard; to the south another industrial building with parking; and to the north the City of Anaheim maintenance yard. Site is isolated; that they looked for a site following specific criteria including not near I(quor stores, convenience markets, parks, schools, churches, etc. and they searched entire city of Anaheim. Feel this site matched that criteria. Bus stop currently located on the corner of East Street, and that he had it confirmed just today that they will be able to locate a bus stop directly in front of the facility. In addition, the current stop at East and Vermont will remain and service will be 10-31-94 Page 11 increased. J. There is residential in the area, painting out apartments, and noting there is also residential about 1 /3 to 1 /2 mile away, but they feel the site is really isolated on all four sides, and with the bus stop directly in front of the facility, there will be no reason for people to mill around the area, other than to conduct their business and leave. K. Presented a rendering of the proposed landscaping; there will be two entrances, one for employees and the entrance for the public will be in the rear, parking in the rear will be secured with wrought iron fencing; and there will be on-site security. L. 241 parking spaces on site; exterior of building will be painted, new landscaping, attractive wrought iron and brick fencing, landscaping planters will be added in the front, on site Sheriffs for security at all times when facility is open. i Harold Martin, stated he is a police officer and also one of the founders of the group wt o started the movement to get the Welfare Office moved from Homer Street because of problems it caused in the area. They did not want a welfare office in Anaheim at all, but the County is obligated to have one here. The County has worked very hard to review a lot of different sites in Anaheim and their group has re(ected a lot of the sites because they were too close to schools, churches, parks, etc. This site offers what is needed. The Homer Street facility, near La Palma Park, is a problem because the park is close, and the freeway is close, and people do congregate there, plus there are liquor stores in the area. This site on Vermont does not have a liquor store nearby and it is not near a park, so people will not stay around all day and will do their business and then leave. The neighbors of this Vermont facility were concerned that the facility would bring crime and other problems (n their area. The Commission has a responsibility to protect the people in the Vermont Street area, but they also have an obligation and have to consider the problems the people around the Homer Street facility are having. Plus, relocating that facility, will allow the - City to use that area to improve La Palma Park. Mr. Martin presented a petition containing about 60 signatures of people who support this request. Commissioner Caldwell stated the Commission is aware of the problems at the Home Street facility. However, Mr. Martin has just g(ven testimony indicating that this use will bring problems in the Vermont Street area and it will have some negative impacts on the residents. Mr. Martin stated moving any use or business into the area would bring crime or other problems to the area. This is a situation where they can take a big problem and turn it into a small problem. He thought 99°k of the problems would be eliminated. Commissioner Henninger asked about other sites which the County reviewed before determining that is the best site. Mr. Martin stated the County did review several sites; that their group also reviewed them, and re(ected them for a lot of different reasons. He stated if the neighbors do experience problems, he will make himself totally available to help organize and solve the problems. PUBLIC HEARING WAS CLOSED. Commissioner Mayer stated she is starting to feel more comfortable about this Vermont Street site, especially with the bus stop directly in front. She asked where the people will go who like to stay in the park now. 10-31-94 Page 12 i I a (f i Mr. Martin stated if people can congregate, bum a bottle of wine off their buddy, etc., they will stay around. At this site, they wll! disperse right away and it is a lot easier to deal with one or ~'y two people, than trying to disperse 10 or 15 people. Scott Stephens, 603 Reed Lane, stated he is a respected community leader and President of the Neighborhood Council in his area. VJorked with Caltrans diligently to extend a sound wall to keep transients out of the neighborhood. Problems at current facility on Homer Street are ca~rsed by liquor stores in the area, apartments, easy access to freeway and the park. Surrounding circumstances cause the problems, and not the facility itself. The only residential use near the Vermont Street site is apartments and there is no school nearby, etc. They have full support of the City Council, Redevelopment, Police, Code Enforcement, Carl Karcher Enterprises, etc. supporting the relocation of the Homer Street facility because of the problems it is causing in that area, pointing out that Karcher Enterprises spends 556,000 on security now to protect their own property because of vandalism to their employees vehicles, etc. A petition was originally submitted with approximately 500 signatures of people who feel the Homer Street site is a bad location. Redevelopment supports relocating that facility because they plan to expand ~~ Palma Park all the way to Romneya. Amin David, 419 S. Polk Street, Anaheim, business located at Broadway and Loara, stated he is deputized to tell the Commission that Las Amigos of Orange County : ~_s taken a stand on this and recommends approval of the Vermont Street site. There seems to be an awful awful connotation when we talk about the welfare office and to far too many people, it is ugly and means give away and not good, but he hoped to the preponderance of the people, it means help, life, compassion, so it draws people from all walks of life. That is what our community is made up of. He suggested perhaps the system of delivering the little bit of help they get should be thought out; and new and innovative ways to deliver should be developed; referring to Social Security checks which are mailed. Perhaps coming Into the welfare office would only be for review of their case. They support this site and think it is very adequate and thought it would be a great tribute to the industrial area and he would not mind having it at all close to his business because it is part of his community and part of the people he lives with. He stated there is a small petition which has been delivered to the Commission, or will be delivered. Commissioner Caldwell stated he made the motion the last time to approve it, and it was defeated, that he is in favor and his heart goes out to the neighbors around it and there is a small risk that maybe they will have a small problem as a result this, but that he will vote in favor of it. ACTION: Commissioner Messe offered a motion, seconded by Commissioner Mayer and MOTION CARRIED that the Anaheim City Planning Commission does hereby find that the County's proposal to lease office space at 901 East Vermont Street for the SSA General Relief and Food Stamp program is in conformance with the General Plan. Chairwoman Boydstun stated she thinks this will be a good location and changed her mind because the bus stop will be located directly in front of the facility and there are no check cashing operations or liquor stores in the area. 10-31-94 Page 13 Commissioner Henninger stated the testimony regarding the existing problems at the current location was very helpful. He asked if the County could assure him that the graphics and photographs showing landscaping and fencing around the site would be complied with. Mr. Rawlings responded the site will be built that way and in addition, they have entered into discussions with various community groups and are very Interested in having participation in how those will be designed. Commissioner Henninger asked if the landscaping and fencing plans could be brought back for review and Mr. Rawlings responded they could certainly do that. He clarified they have an agreement that if they move forward with this, they would be committed legally to the lessor to do it. Commissioner Henninger stated he would appreciate seeing the final plans before going out to ~ contract and Mr. Rawlings responded they are designed exactly as shown and Commissioner Henninger asked where the fencing would be. Mr. Rawlings stated the fencing would be across the entire perimeter of the tacillty, pointing out they moved it back after hearing ~ neighbors' concerns to make it more attractive. It doesn't affect the security. Commissioner Henninger stated his concerns are answered. FINAL SITE PLAN REVIEW APPLICATION FOR THE ANAHEIM Approved RESORT SPECIFIC PLAN: Request for Planning Commission review (Vote: 7-0) and approval. RESOLUTION N0. PC94148 Linda Jonson, Senior Planner, explained it is wr(tten in the Anaheim Resort Specific Plan Zoning Code that the application wilt be approved by resolution. She also explained responding to Commission's input, staff has added another line to the Project Summary sheet regarding the minimum dimension of a parking space She explained this is a new process and we do not have any forms like this Commissioner Henninger asked if the list as shown would limit what can be requested. Ms. Johnson responded as stated in the Zoning Code, it says the submittal requirements would be set forth in this application, but that the Planning Director could require additional (nformation. Commissioner Henninger was concerned about the actual submittal requirements list and the second sentence indicating that due to the nature of the applicat!on, staff may reduce the number of plans and documents that are needed to review the proposal. The document he referred to was "Anaheim Resort Specific Plan Final Site Plan Review Pre-Application Submittal Requirements". Linda Johnson suggested adding, "and such other Information as required" Selma Mann suggested revising where it reads, "due to the nature of your application, staff may reduce", to read, "staff may revise". She explained the reason for this request is that one applicant indicated that indeed they met all the parking requirements because it was their Intent to have people standing. Commissioner Henninger offered Resolution No. PC 94-150 making the interpretation that the Commission does find that parking requirements for live theater and theaters in general should be determined by the number of seats or the number of patrons, whichever is greater. The resolution was adopted with 7 yes votes. MOTION: Commissioner Henninger offered a Motion, seconded by Commissioner Messe and MOTION CARRIED that the Planning Commission does hereby direct staff to agendize a code amendment pertaining to the parking requirements for live performance theaters that the parking spaces should be determined by the number of seats or the number of patrons, whichever is greater.
