AND SARAH ANN F0~lLER~ 3178 East La Patma Ave~ue. Anahelm. California, 92606, owners, and CREVIER INPORTS, i061 "H" Shepard Street. Anahein, Californla 92806. agent, of certain real propcrty situated in the City of Anaheim, Courtty of Orange, State of Latifornla, described as: That portion of Lot 20 in Block K of the Kraemer Tract, as shown on a Map recorded in Boolc 12, page 87 and 88 of MTscellaneous Records of Los Angeles Coun[y, California~ described as follows: Parcel No. 2. as shown on a Map filed in Book 55~ page 47 of Parcel Maps in the office of the Coun[y Recorder of Orange Gounty, California. That the proposed use is properly one for which a condittonal use permit is authorized by Anaheim Municipa! Code Section 18.61.050,070 to wit: to permit an autornobtle repair and restoration facility. 2. That the proposed use Is hereby granted for a trro-year period. subject to review and consideration for an extenston of time to determine whether the use has had a detrimental effect o~ the surrounding industrlal area. 3. That the proposed use will not adversely affect the adjoTni~g land uses a~d the grow[h and development of the area In which it is proposed to be located. ~. That the size and shape of the site proposed for tha use is adequate to a11ow the full developme~t of the proposed use in a manner not detrimental to the particu)ar area nor to the peace, health, safety~ and general welfare of the Citizens of the Ctty of Anaheim. 5. That the granting of the Conditional Use Permlt under the conditions tmposed~ if any, will not be detrimental to the peace~ health, safety and general welfare of the Cittzens of the Ctty of Anaheim. 6. That no one indtcated their presence at sald public hearing Tn opposition; and that no correspondence was receTved in opposltion to the subJect pctition, PC78~112 ENVIRONMENTAL IMPACT FINDING: The Planning Director or his authorized representat ve has eterm ned that the proposed proJect falls w(thtn the deftnition of Categorical Exemptions, Class 1, as defined in Paragraph 2 of the Ctty of Anaheim Environmental Impact Report Guidelines and is. therefore. categorically exempt fran the requirement to prepare an EIR. NOW, THEREFORE, BE iT RESOLVED that the Anaheim CTty Planning Commission does hereby grant subJect Petitlon for Condltional Use Permit. upon the following condttions which are hereby found to be a necessary prerequlsite to the proposed use of the subJect property in order to preserve the safe[y and general welfare of the Citlzens of the City of Anahefm: i. That sidewalks shall be installed along La Palma Avenue and Shepard Street as requlred by the Ctty EngTneer and in accordance with standard plans and speciflcations on file ln the Office of the City Englneer. 2. That subJect property shail be developed substantially i~ accordance with plans and specifications on file with the Lity of Anaheim marked Exhibi[ Nos. 1 through 3. 3, That Condition Nos. 1 and 2, above-mentioned, shall be complted with prlor to final building and zontng Inspections. 4, That the proposed use is yranted for a two-year period~ subJect to review and consideratton for an extension of time, upon writted request by the petitioner, to determine whether the use has had a Jetrimenial effect on the surrounding indusLria) area. BE IT FURTHER RESOLVEO that the Anaheim CTty Planning CamTsslon does hereby find and determine that adoptlon of this Resolutton ts expressly predicated upon appllcant~s compliance Htth each and all of the conditions hereinabove set forth. Should any such condition~ or any part thereof, be declared invaild or unenforceable by the final Judgment of any court of competent jurisdictio~, then this Resolution, and any approvals herein contained, shall be deemed null and votd.
