RES-2022-028RESOLUTION NO. 2022 - 0 2 8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING A LETTER OF UNDERSTANDING BETWEEN THE ANAHEIM MUNICIPAL EMPLOYEES ASSOCIATION, CLERICAL EMPLOYEES UNIT, AND THE CITY OF ANAHEIM CONCERNING UPDATES TO THE SALARY RELATIONSHIPS AND TRAINING DUTY ASSIGNMENT PAY WHEREAS, the City of Anaheim ("City") and the Anaheim Municipal Employees Association, Clerical Employees Unit, ("AMEA") executed a Memorandum of Understanding ("MOU") on wages, benefits, and other terms and conditions of employment for employees represented by the AMEA on September 6, 2019; and WHEREAS, Appendix "A" — Special Provisions, A.7., of the MOU established working groups to further discuss during the term of the MOU 1) updating the salary relationships, 2) the payment of training duty assignment pay for specific employees in the Anaheim Police Department, 3) changes to the boot allowance and 4) revisions to Article 41.1 — Overtime — General; and WHEREAS, representatives from the City and the AMEA met and discussed in good faith on the terms of Appendix "A" — Special Provisions, A.7., and reached an agreement on updating the salary relationships and payment of training duty assignment pay for specific employees in the Anaheim Police Department; and WHEREAS, as a result thereof, a Letter of Understanding ("LOU") dated January 27, 2022 between the parties has been prepared and signed; and WHEREAS, the changes incorporated in the LOU are reflective of previous and current practice; and WHEREAS, the City Council of the City of Anaheim finds that approval of the LOU between the City of Anaheim and the AMEA is in the best interest of the City of Anaheim. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim that the LOU dated January 27, 2022 between the City of Anaheim and AMEA, a copy of which is attached hereto and incorporated by reference herein, is hereby approved. // // // // THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 15 day of March , 2022, by the following roll call vote: AYES: Mayor Sidhu and Council Members O'Neil, Diaz, Ma'ae, Moreno, Valencia and Faessel NOES: None ABSENT: None ABSTAIN: None ATTEST - CITY CL OF THE CITY OF ANAHEIM LETTER OF UNDERSTANDING between the ANAHEIM MUNICIPAL EMPLOYEES ASSOCIATION, CLERICAL EMPLOYEES, and the CITY OF ANAHEIM The Anaheim Municipal Employees Association ("AMEA"), Clerical Employees, and the City of Anaheim ("ANAHEIM"), hereinafter referred to collectively as the "PARTIES" have met and conferred in accordance with Appendix "A" Special Provisions, Article A.7., within the January 5, 2018 through June 23, 2022 Memorandum of Understanding ("MOU") between the AMEA and ANAHEIM, and reached an agreement with regard to the new provision of Training Duty Assignment Pay. The PARTIES have agreed to the following terms and conditions: Effective the first full pay period following City Council approval, employees who work in a classification in the Police Department listed below and who are temporarily assigned as a primary trainer for new employees shall receive a five percent (5%) pay differential above their base pay for each hour training duties are actually performed. To be eligible for the differential as a primary trainer, the employee must be the individual required to complete the daily trainee evaluation for any training duty assignment. Training duties will be assigned in a minimum of two (2) hour increments. Employees serving in the designated classifications are eligible for Training Duty Assignment Pay. The Police Chief may approve eligibility for additional classifications not listed below as he/she deems appropriate. An employee temporarily assigned to perform training duties may be removed from such assignment at the sole discretion of the Police Chief. Finally, the PARTIES acknowledge that discussions on revisions to Article 41.1 did not result in agreement and as such, the discussions shall be included in the upcoming successor MOU negotiations. The remainder of the MOU between the AMEA, Clerical Employees, and ANAHEIM shall not be affected hereby and shall remain in full force and effect.
