RES-2022-049 RESOLUTION NO. 2022-0 49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM RATIFYING AND APPROVING THE ACTIONS OF THE ANAHEIM DIRECTOR OF COMMUNITY SERVICES, OR DESIGNEE, IN SUBMITTING A GRANT APPLICATION ON BEHALF OF THE CITY OF ANAHEIM TO THE CALIFORNIA DEPARTMENT OF TRANSPORTATION (CALTRANS) FOR THE CLEAN CALIFORNIA LOCAL GRANT PROGRAM FOR THE NORTH LA PALMA GREEN PROMENADE,PASEO AND PARKING LOT PROJECT AND, AUTHORIZING THE ACCEPTANCE OF SUCH GRANT ON BEHALF OF THE CITY; AND, DETERMINE THAT THESE ACTIONS ARE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)PURSUANT TO GUIDELINE SECTION 15306 WHEREAS, the Clean California Local Grant Program is a competitive statewide program created to beautify and clean up local streets and roads, tribal lands, parks, pathways, transit centers, and other public spaces; and WHEREAS, Assembly Bill 149 (Sec.16) created the Clean California Local Grant Program of 2021 and was codified under Streets and Highway Code §91.41 et.al. The Program is one part of the nearly$1.1 billion Clean California initiative that takes direct aim at the continuous trash generation that has overwhelmed the significant investment of time and resources by Caltrans and its partners collecting, recycling, and disposing of litter and hazardous waste; and WHEREAS, the California Department of Transportation ("Caltrans") has allocated funds, the Clean California Local Grant Program, for community litter abatement and beautification projects and community litter abatement events and/or educational programs (the "Grant")(; and WHEREAS,the City has proposed to create the North La Palma Promenade, Paseo and Parking lot Project,transforming the entirely asphalt, two-way North La Palma Parkway into an attractive pedestrian/bicycle friendly, tree-lined, one-way corridor(the "Project") ; and WHEREAS, Caltrans has evaluated, ranked and awarded proposals submitted for Grant funding and awarded the City of Anaheim grant funds to be used for the Project; and WHEREAS, the Clean California Local Grant Program requires a resolution certifying the approval of the application by the applicant's governing body before receipt of awards; and WHEREAS,the Community Services Director,through its designee,and on behalf of the City of Anaheim, submitted an application to Grantor for said Grant; and WHEREAS,the City received approval for funding by Grantor for the Project; and 1 WHEREAS,the City is willing and able to conform to each of the terms,conditions and limitations imposed upon any such Grant awarded to the City; and WHEREAS, the City desires to accept any such Grant which may be awarded to the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. Approves and ratifies the actions of the Director of Community Services or designee in filing of an application for the Clean California Local Grant Program. 2. The City Council of the City of Anaheim hereby agrees to, and by this resolution, does accept any such Grant so awarded to.the City of Anaheim without further action of the City Council being required therefore and further agrees to commit $879,690, as match to Grant funds of$2,639,009, for a total of$3,518,699. 3. The City of Anaheim hereby affirms its compliance and agreement to comply with each and all of the terms, conditions and limitations imposed by the Grantor upon said Grant, and the City Council hereby ratifies actions taken by and approves actions to be taken on behalf of the City,by Anaheim Director of Community Services,or designee,including but not limited to, execution of any agreements, assurances, or other documents as may be necessary in connection with completion of the Project(s) and the acceptance of said Grant. 4. The receipt of the Clean California Local Grant Program Award is exempt from CEQA under guideline section 15306, which pertains to information gathering purposes leading to an action that a public agency has not yet approved, adopted or funded.
