RES-2022-070 RESOLUTION NO. 2022- 070 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FOR EXCEPTION TO THE 180-DAY WAIT PERIOD IN COMPLIANCE WITH GOVERNMENT CODE SECTIONS 7522.56 AND 21224 AND SUPERSEDING RESOLUTION NO. 2022-051. WHEREAS, in compliance with Government Code Section 7522.56 the City Council of the City of Anaheim must provide CalPERS this certification resolution when hiring a retiree before 180 days has passed since his or her retirement date; and WHEREAS, Maria Munoz retired from the City of Anaheim in the position of Dispatcher II, effective April 14, 2022; and WHEREAS, Section 7522.56 requires that post-retirement employment commence no earlier than 180-days after the retirement date, without this certification resolution; and WHEREAS, Section 7522.56 provides that this exception to the 180-day wait period shall not apply if the retiree accepts any retirement-related incentive; and WHEREAS,the City Council of the City of Anaheim,the City of Anaheim Human Resources Department and Maria Munoz has not and will not provide any other retirement-related incentive; and WHEREAS, the City Council of the City of Anaheim hereby appoints Maria Munoz as an extra help retired annuitant to perform the duties of the Police Dispatcher II for the City of Anaheim under Government Code Section 21224, effective May 25, 2022; and WHEREAS, the appointment of Maria Munoz and the City of Anaheim has been reviewed by this body; and WHEREAS,no matters, issues,terms or conditions related to this employment and appointment will be placed on the consent calendar; WHEREAS, the employment shall be limited to 960 hours per fiscal year; and WHEREAS,Maria Munoz was appointed to fill a critically needed position on May 24, 2022 by Resolution No. 2022-051; and WHEREAS, the City Council of the City of Anaheim finds that waiver of the 180- day wait period and appointment of Maria Munoz to fill the critically needed position of Dispatcher II for the City of Anaheim necessitates a separate action on the off-consent calendar pursuant to the governing code; and THEREFORE,BE IT RESOLVED THAT the City Council of the City of Anaheim hereby rescinds Resolution No. 2022-051 and further certifies the nature of the appointment of Maria Munoz as described herein and that this appointment is necessary to fill the critically needed position of Police Dispatcher II for the City of Anaheim effective May 25, 2022.
