A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM WAIVING BUILDING -RELATED FEES
APPLICABLE TO THE ACCESS CALIFORNIA SERVICES
PROJECT AT 300 WEST CARL KARCHER WAY
WHEREAS, Access California Services ("AccessCal") is a non-profit corporation
operating in the City of Anaheim for 23 years, providing services to the Anaheim community
including case management and client advocacy, access to health coverage, employment
services, emergency financial assistance, homeless and senior services, mental health, citizenship
and immigration assistance, a microenterprise training program, tax preparation assistance,
education and after -school services, youth mentoring, parenting classes, home visitation, and
veterans services; and
WHEREAS, the City approved a Lease Agreement with AccessCal on January 25,
2022 for the Ground and Facilities at 300 West Carl Karcher Way (the "Project Site") in the City
of Anaheim, at a rate of $1 per year for a period of ten years, with up to two five-year renewal
options; and
WHEREAS, as part of the Lease Agreement, AccessCal assumes responsibility for all
expenses related to the operation, programming, and services on the grounds and facilities
including, but not limited to, providing the resources necessary for staffing, taxes, and
assessments, cost of tenant improvements to existing space and completion of said improvements
within one year, general maintenance, utilities, landscaping, refuse disposal, and operations
supplies and equipment; and
WHEREAS, AccessCal is in the process of constructing tenant improvements to the
existing City -owned building at the Project Site that are reasonably necessary to provide the
community services anticipated as part of the Lease Agreement; and
WHEREAS, the applicant, Nahla Kayali, Founder and Executive Director of
AccessCal, has submitted a request to City Council for a waiver of building -related fees, in the
form of a reimbursement of fees already paid totaling $13,295.65; and
WHEREAS, Sections 18.80.020 (Schedule of Fees) and 10.09.040 (Permits) of the
Anaheim Municipal Code and the provisions of State law authorize the City Council to establish
fees, charges and rates, for the purpose of defraying the costs and expenses to the City of
Anaheim for processing applications for permits and for inspections, re -inspections and other
services and activities relating to the "Building Standards Codes" of the City of Anaheim (as
defined in Section 15.03.010 of the Anaheim Municipal Code) and pertaining to the regulation of
building and construction activities, permits and activities subject to National Pollutant
Discharge Elimination System ("NPDES") requirements; and
WHEREAS, the City Council adopted Resolution No. 2018-074 establishing a
schedule of fees charges and rates for building construction and NPDES permits, services, and
activities;
WHEREAS, Access California Services is a non-profit community partner that
provides a needed service to City of Anaheim residents and community members, and the
facility's services help offset the City's need to fund similar services; and
WHEREAS, the City Council desires to waive building -related fees applicable to the
Project totaling $13,295.65.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1.
The City Council of the City of Anaheim does hereby waive the $13,295.65 in
building -related fees applicable to the AccessCal project, and further hereby directs the Planning
and Building Director to reimburse AccessCal for the payment of said fees.
SECTION 2.
Neither this Resolution nor anything contained herein shall be construed as amending
or modifying any existing fee resolution of the City of Anaheim.
