RES-2022-090RESOLUTION NO. 2022-090 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM TO REVISE AN APPLICATION FEE FOR EXTENSION OF TIME TO COMPLY WITH CONDITIONS OF APPROVAL AND ESTABLISH A FEE FOR OUTDOOR DINING PARKING PERMIT WHEREAS, under Section 18.60.170 (Extension of Time to Comply with Conditions of Approval) of Chapter 18.60 (Procedures) and Section 18.42.130 (Outdoor Dining Parking Permits) of Chapter 18.42 (Parking and Loading) of Title 18 (Zoning) of the Anaheim Municipal Code, an applicant must pay a fee at the time in an amount established by resolution of the City Council for the purpose of defraying the costs and expenses to the City of Anaheim (the "City") for the processing of applications; and WHEREAS, the City Council desires to revise the fee to process an Extension of Time to Comply with Conditions of Approval and establish a fee to process applications for Outdoor Dining Parking Permits; and WHEREAS, the fee hereinafter established are less than or equal to, but in any event do not exceed, the actual direct and indirect costs and expenses incurred by the City in receiving, processing, analyzing, acting upon and administering applications for an Extension of Time to Comply with Conditions of Approval authorized by Section 18.60.170 (Extension of Time to Comply with Conditions of Approval) and Outdoor Dining Parking Permits authorized by Section 18.42.130 (Outdoor Dining Parking Permits). WHEREAS, pursuant to and in accordance with the provisions of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.; herein referred to as "CEQA"), the State of California Guidelines for Implementation of the California Environmental Quality Act (herein referred to as the "CEQA Guidelines"), and the City's Local CEQA Procedure Manual, the City is the "lead agency" for the preparation and consideration of environmental documents for "projects", as that term is defined in Section 15378 of the CEQA Guidelines; and WHEREAS, the City Council finds and determines that this Resolution is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 21080(b)(8) of the California Public Resources Code in that said fee is established to meet operating expenses, including employee wage rates and fringe benefits and purchasing or leasing of supplies, equipment, materials and services.; and NOW, THEREFORE, the City Council of the City of Anaheim resolves, finds and determines on the basis of the facts set forth in the agenda report presented to it and any testimony received at the meeting at which this matter was considered, as follows: Section 1. The foregoing recitals are true and correct. Section 2. The application fee of Five Hundred and Ninety Five ($595.00) as set forth in Exhibit A attached hereto is hereby adopted and shall accompany any application submitted -1- pursuant to Section 18.60.170 (Extension of Time to Comply with Conditions of Approval) of Chapter 18.60 (Procedures) of Title 18 (Zoning) of the Anaheim Municipal Code. Section 3. The application fee of Seven Hundred and Sixty Three ($763.00) as set forth in Exhibit A attached hereto is hereby adopted and shall accompany any application submitted pursuant to Section 18.42.130 (Outdoor Dining Parking Permits) of Chapter 18.42 (Parking and Loading) of Title 18 (Zoning) of the Anaheim Municipal Code.
