69R-339WHEREAS, public convenience and necessity require the acquisition of certain real property within the City of Anaheim for the following purposes, to wit: highway easement and public utility purposes; and WHEREAS, the City Council does find and determine that public interest and necessity require the acquisition of all that real property herein described, by the City of Anaheim for high- way easement and public utility purposes. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that public interest and necessity require the acquisition of the following described real property, to wit: All that certain real property situated in the City of Anaheim, County of Orange, State of California, more particularly described as follows, to wit: Parcel One; That portion of the East half of the Southeast quarter of the Northwest quarter of Section 23, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, lying Northeasterly of the Northeasterly line of the right of way of the Atchison, Topeka and Santa Fe Railway Company. Parcel Two: RESOLUTION NO. 69R -339 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DETERMINING THE NECESSITY FOR, AND DIRECTING THE ACQUISITION, BY EMINENT DOMAIN OF REAL PROPERTY FOR HIGHWAY EASEMENT AND PUBLIC UTILITY PURPOSES. An easement for road and public utility purposes, and for the construction and maintenance of slope areas, over, under and across that portion of the Southeast quarter of the Northwest quarter of Section 23, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, described as follows: Beginning at the Southeast corner of Lot 16, Tract No. 4408, as shown on a Map recorded in Book 15 pages 37 and 38 of Miscellaneous Maps, records of said county; thence North 5 15' 26" West, 401.65 feet to a point in the north line of said tract; thence North 7 26' 20" West, 160.00 feet; thence North 0° 15' 29" West, 234.80 feet to a point in the Southwesterly line of the Atchison, Topeka and Santa Fe Railway Company's right of way; thence Southeasterly along said Southwesterly line to an intersection with the East line of the Northwest quarter of said Section 23; thence South 0° 15' 29" East along said East line, 596.83 feet; thence South 89 44' 31" West, 45.00 feet to the point of beginning. Excepting that portion of said land now included within Lewis Street. Together with any and all Lewis Street which may be property to the west over described above as having distances: Parcel Three: rights of access to said appurtenant to the remaining and across those courses the following bearings and North 5° 15' 26" West, 401.65 feet; North 7 26' 20" West, 160.00 feet; North 0° 15' 29" West, 234.80 feet. An easement for road and public utility purposes, including construction and maintenance of slope areas, over, under and across that portion of the Northeast quarter of Section 23, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of. Orange County, described as follows: Beginning at the intersection of the West line of said Northeast quarter with the Northeasterly line of the Atchison, Topeka and Santa Fe Company's right of way (100 feet wide); thence along said West line, North 0° 15' 29" West, 632.63 feet; thence North 89° 56' 01" East, 45.00 feet; thence South 0° 15' 29" East, 100.00 feet; thence North 89° 44' 31" East, 13.00 feet; thence South 2° 27' 44" East, 260.00 feet; thence South 7 32' 08" East, 228.90 feet; thence South 0° 15' 29" East 235.00 feet to a point in a curve concave Northeasterly and having a radius of 5649.65 feet, a radial line bearing South 62° 07' 06" West passes through said point (said curve being concentric with and distant Northeasterly 30 feet measured radially from the Northeasterly line of said railway right of way); thence Northwesterly along said curve, through a central angle of 1° 16' 25 an arc distance of 125.58 feet; thence South 89° 44' 31" West, 33.45 feet to a point in the Northeasterly line of said railway right of way, said point being in the arc of a curve, con- cave Northeasterly and having a radius of 5679.65 feet, a radial line bearing South 63° 32' 30" West passes through said point; thence Northwesterly along said curve, through a central angle of 0° 09' 01 an arc distance of 14.90 feet to the point of beginning. Together with all rights of access to Lewis Street from the adjoining property to the east over and across those certain courses described above as having the following bearings and distances: BE IT FURTHER RESOLVED that the City Council find, and it does hereby find and determine, that public interest and necessity require the acquisition of said property by the City of Anaheim for the aforesaid purposes, and that the taking of the property hereinabove described is necessary therefor, and that the uses to which it is to be put are uses authorized by law, and the taking of said property is necessary to such uses. AND BE IT FURTHER RESOLVED that the City Council does hereby authorize the acquisition of said property by the City of Anaheim, and `the City Attorney of the City of Anaheim is hereby directed to institute an action in eminent domain for the acquisi- tion the title to said property, and to perform and carry out all`of the necessary 'proceedings and steps incident to the acquisi- tion of the title to said property.
