69R-286A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 1111 IN PART. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from W. H. Jewett, 1309 East Orangethorpe Avenue, Fullerton, California, submitted by Maurice B. Dillow as Agent for W. H. Jewett, to permit the establishment of a 50 unit motel, with waivers of front setback from a major arterial highway, maximum height of free- standing sign, maximum area of free- standing sign, and location of free standing sign, on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: Parcel No. 1 RESOLUTION NO. 69R -286 That portion of Lots 4 and 5 of Tract No. 71, in the City of Anaheim, County of Orange, State of California, as shown on a Map recorded in Book 10, page 22 of Miscellaneous Maps, in the office of the County Recorder of said County, described as follows: Beginning in the centerline of a 60 foot road along the Westerly side of Lots 4 and 5 as shown on said Map (said road being now known as State College Blvd., and formerly as Placentia Avenue) at a point 215.43 feet South of the intersection of said centerline with the Westerly prolongation of the South line of said Lot 5, being the Northwest corner of the land described in Parcel No. 1 in the Agree- ment recorded December 28, 1926 in Book 694, page 8 of Deeds, records of said County; thence South 89° 59' 15" East parallel with the South line of Lot 5 a distance of 250 feet; thence North 0° 08' 00" West parallel with the centerline of State College Blvd., 249.81 feet; thence North 89° 59' 15" West parallel with said South line of Lot 5 to the center- line of said State College Blvd; thence North along said centerline 8.33 feet; thence South 89° 59' 15" East parallel with said South line 250 feet; thence North 0 08' 00" West 28.34 feet; thence South 89° 59' 16" East 54.00; thence North 0° 08' 00" West 36.00 feet; thence South 89° 59' 16" East 26 feet; thence North 0° 08' 00" West 216.11 feet to the centerline of Katella Avenue, as said centerline is described in the Final Order of Condemnation filed July 8, 1960 and recorded in Book 5321, page 397 of Official Records of said Orange County; thence Easterly along said centerline to an inter- section with a line that is parallel with and distant 435 feet Easterly (measured along the South line of said Lot 5) of the centerline of State College Blvd.; thence South 0° 08' 00" East along said parallel line to an intersection with a line that is parallel with and 215.43 feet South (measured along the centerline of State College Blvd.) of the South line of said Lot 5; thence West along said parallel line to the true point of beginning. EXCEPTING THEREFROM that portion included within the said 60 foot road as shown on said Map of Tract No. 71. Reserving an easement over the most Westerly 220 feet of said land for ingress and egress. Parcel No. 2 An Easement over the North 8.33 feet of that portion of Lot 5 of Tract No. 71, in the City of Anaheim, County of Orange, State of California, as shown on a Map recorded in Book 10, page 22 of Miscellaneous Maps, in the office of the County Recorder of said County, described as follows: Beginning in the centerline of a 60 foot road along the Westerly side of Lots 4 and 5 as shown on said Map (said road being now known as State College Blvd., and formerly as Placentia Avenue) at a point 215.43 feet South of the intersection of said centerline with the Westerly prolongation of the South line of said Lot 5; being the Northwest corner of the land described in Parcel No. 1 in the Agreement recorded December 28, 1926 in Book 694, page 8 of Deeds, records of said County; thence South 89° 59' 15" East, parallel with the South line of said Lot 5 a distance of 250 feet; thence North 00 08' 00" West parallel with the centerline of State College Boulevard 249.81 feet; thence North 89° 59' 15" West parallel with said South line of Lot 5 to the centerline of said State College Blvd; thence South along said centerline to the true point of beginning. EXCEPTING THEREFROM that portion included within the said 60 foot road as shown on said Map of Tract No. 71. Parcel No. 3 An easement 8.34 feet in width over a portion of Lot 5 of Tract No. 71, in the City of Anaheim, County of Orange, State of California, as shown on a Map recorded in Book 10, page 22 of Miscellaneous Maps, in the office of the County Recorder of said Orange County; the South line of said easement being described as follows: Beginning in the centerline of a 60 foot road along the Westerly side of Lots 4 and 5 as shown on said Map (said road being now known as State College :Boule vard; and formerly as Placentia Avenue) at a point 215.43 feet South of the intersection of said center- line with the Westerly prolongation of the South line of said Lot 5, being the Northwest corner of the land described in Parcel No. 1 in the Agreement recorded December 28, 1926 in Book 694, page 8 of Deeds, records of said County; thence South 89° 59' 15" East parallel with the South line of Lot 5 a distance of 250 feet; thence North 0° 08' 00" West parallel with the centerline of State College Blvd., 249.81 feet; thence North 89° 59' 15" West parallel with said South line of Lot 5 to the centerline of said State College Blvd; thence North along said centerline 8.33 feet, to the true point of beginning; thence South 89° 59' 15" East parallel with said South line 250 feet. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on April 21 1969 notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. PC 69 -86, granting Conditional Use Permit No. 1111 in part subject to the conditions therein set forth; and WHEREAS, thereafter within twenty -two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in granting in part said Conditional use permit and said appeal was set for public hearing on May 20 1969 at the City Hall, in the City of Anahe m and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Com- mission granting in part said conditional use permit be, and the same is hereby approved with the following stipulation, and that Conditional Use Permit No. 1111 be, and the same is hereby, granted permitting the establishment of a 50 -unit motel with waiver of front setback from arterial highway (18.52.060[2 -a -1]) maximum height of free- standing sign (18.62.090[B -2]), maximum area of free standing sign (18.62.100[B -1]), pursuant to stipulation that the sign projected for State College Boulevard shall not exceed 25 feet in height, with a maximum area of 100 square feet, said sign to become integrated as other parcels sharing the common easement develop on the property hereinbefore described subject to the following conditions: 1. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Katella Avenue and State College Boulevard, for street lighting purposes. 2. That the owner of subject property shall pay to the City of Anaheim the sum of 15 per front foot along Katella Avenue and State College Boulevard, for tree planting purposes. 3. That a Parcel Map to record the approved division of subject property be submitted to the City of Anaheim for approval and then be recorded in the Office of the Orange County Recorder. 4. That the sidewalks and driveways shall be installed along Katella Avenue and State College Boulevard, as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. 5. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works. 6. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 7. All construction within the Orange County Flood Control District easement shall be in accordance with district requirements. 8. That all air- conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent residential homes. 9. That Conditions Nos. 1 and 2, above mentioned, shall be complied with prior to the time that the Building Permit is issued or within a period of 180 days from date hereof, whichever occurs first, or such further time as the mmcCity Council may grant. ft 6, 10. That Conditions Nos. 3, 4, 5, 6, 7, and 8, above mentioned, shall be complied with prior to final building and zoning inspections. The City Council hereby reserves the right to revoke such conditional use permit for good cause or failure of said owners, their heirs, successors or assigns, to comply with the Anaheim Municipal Code, and the stipulation, regulations, and conditions herein. THE FOREGOING RESOLUTION is approved and signed by me this 20th day of May, 1969. ATTEST: 11. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1, 2, 3, and 4, as they pertain to the sign on the Katella Avenue frontage; provided, however, that all covered vehicular entryways shall have a minimum vertical clearance of 14 feet; and further provided, that kitchen efficiency units with a maximum of 6 -cubic foot refrigerators, 2- burner stoves, excluding oven and baking facilities, and single compartment sinks may be provided, with the excep- tion that the manager's unit will be allowed to have full kitchen facilities.
