69R-265RESOLUTION NO. 69R- 265 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AND AUTHORIZING THE EXE- CUTION OF AN AGREEMENT BETWEEN THE CITY OF ANAHEIM AND THE COUNTY OF ORANGE, WITH REFER- ENCE TO THE MAINTENANCE AND REPAIR OF THE LINCOLN AVENUE BRIDGE CROSSING THE SANTA ANA RIVER. WHEREAS, the County of Orange is proposing to main- tain and repair the Lincoln Avenue Bridge crossing the Santa Ana River; and WHEREAS, said bridge is partially within the City of Anaheim; and WHEREAS, the County and the City consider it in the best interests of economics and public safety to combine the improvements in their respective jurisdictions into one pro- ject; and WHEREAS, the County has tendered to the City a form of agreement to be entered into between the parties providing for the joint maintenance and repair of the Lincoln Avenue Bridge; and WHEREAS, the City Council finds that the terms and conditions of said agreement are satisfactory and that said agreement should be approved. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the agreement tendered to the City by the County of Orange, to be made and entered into between the parties, providing for the joint maintenance and repair of the Lincoln Avenue Bridge, to which reference has been made, upon the terms and conditions hereinafter set forth, be and the same is hereby approved. Said terms and conditions are as follows: I. The project shall consist of cleaning, repairing as necessary, and bolting together four (4) hinges on said bridge. II. City Shall: A. Prepare the detailed plans, specifications and estimate for the project. B. Have jurisdiction of the construction area of the bridge within County. C. Be and is hereby designated as the Project Engineer, contracting and construction agent for the parties to do and perform all acts necessary or required in order to construct the project in accordance with the plans and specifications, including material control, inspection of the construction work, and to execute and deliver all documents necessary or required in connection with the construc- tion and completion of said project, including certificate of day labor, equipment and material cost and certificate of completion of the project. ATTEST: III County Shall: A. Approve plans and specifications as to design and construction features affecting the con- struction, operation and maintenance of the portion of the project within County. B. At all time during the progress of construction of the project have access to the work for the purpose of inspection thereof and should County deem any remedial measures to be necessary, County shall notify the City Engineer thereof. IV. Upon completion of the project, County's share of the cost of the repair of the bridge shall be based on the contract lump sum bid price for said portion of the contract, and be in the ratio of the number of hinges to be repaired lying within the jurisdic- tion of County to the total number of hinges on the bridge to be repaired, as the City limits exist at the time the City advertises the contract for the project. As of the date of this agreement, said County share is considered to be one- fourth (1/4) of the lump sum bid price for the hinge repair based on the fact that one (1) hinge lies within County and three (3) hinges lie within City territory. V. County's share of design, survey and construction engineering costs shall be the actual costs accrued to the County portion based on the percentage of the total contract unit costs billed to County. VI. Upon completion of the project, City agrees to submit full, true and correct copies of documents, certifi- cates and itemized bills to County, and County shall reimburse City within thirty (30) days upon sub mission of statement of such costs for the County portion of the construction as defined by paragraphs IV and V hereof. Such bills shall be based on the actual quantities of construction and the contract bid prices, and shall include a charge for overhead on the engineering and inspection performed by City. VII. The total cost to City is presentlyestimated to be $4,500 and the total cost to County is presently estimated to be $1,500, including engineering costs. BE IT FURTHER RESOLVED that the Mayor and City Clerk be, and they are hereby authorized to execute said agreement for and on behalf of the City of Anaheim.
