A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AND AUTHORIZING
THE EXECUTION. OF UTILITIES AGREEMENT NO.
7Ut -3981 WITH THE STATE OF CALIFORNIA,
FOR RELOCATION AND ENCASEMENT OF CERTAIN
'UTILITY FACILITIES IN CONNECTION WITH THE
CONSTRUCTION OF THE RIVERSIDE FREEWAY
(ROAD 07-Ora-91 9.2/13.9)
WHEREAS, construction of the Riverside Freeway, Road
07- Ora -91 9.2/13.9, requires the relocation and encasement of
water facilities within and adjacent to the construction area
of the Riverside Freeway (Route 55/91 Interchange to the
Riverside .County Line); and
WHEREAS, relocation is required of certain utility
facilities owned by the City of Anaheim; and
WHEREAS, the cost of said work is to be borne by the
State, because certain recorded easements establish the City's
prior rights; and
WHEREAS, the State of California, Department of Public
Works, Division of Highways, has submitted to the City Council
Utilities Agreement No. 7Ut -3981 to be made and entered into by
and between the City and the State, providing for the relocation
and encasement of certain water facilities owned by the City
within and adjacent to the construction area of the Riverside
Freeway (Route 55/91 Interchange to the Riverside County Line),
upon the terms and conditions and in accordance with the pro
cedure set forth in said agreement, 85.52% of the actual cost
of construction, which represents the percentage of replacement,
in kind (without betterment), of the work to be performed, to
be borne by the State; and
WHEREAS, the City Council finds that it would be for
the benefit and best interest of the City to enter into said
agreement with the State of California.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that Utilities Agreement No. 7Ut -3981,
this day submitted to the City Council by the State of California,
Department of Public Works, Division of Highways, to be made
and entered into by and between the City and the State for
relocating and encasing certain water facilities owned by the
City within and adjacent to the construction area of the
Riverside Freeway (Route 55/91 Interchange to the Riverside
County Line), upon the terms and conditions and in accordance
with the procedure set forth in said agreement, and providing
for 85.52% of the actual cost of construction, which represents
the percentage of replacement, in kind, of the work to be
performed, to be paid by the State, be, and the same is hereby
approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized to execute said agreement
for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 8th day of April 19 69
