A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE SETTLEMENT
OF CERTAIN EMINENT DOMAIN LITIGATION;
AUTHORIZING AND DIRECTING THE ACCEPTANCE
AND RECORDATION OF EASEMENT GRANT DEEDS;
AND AUTHORIZING PAYMENT IN CONNECTION
THEREWITH.
WHEREAS, heretofore on the 9th day of July, 1968, the
City of Anaheim filed suit to condemn certain parcels of land
for the widening of Western Avenue in the City of Anaheim,
being Superior Court No. 161132, entitled "City of Anaheim vs.
Reginald E. Donovan, et al.; and
WHEREAS, defendants Albert J. Etchandy, Lois Alta
Etchandy, Robert D. Etchandy, Margaret Gay Etchandy, Dominic
C. Etchandy, and Betty Jean Etchandy, have agreed to settle their
portion of such litigation for the amount on deposit with the
Superior Court for immediate possession, and have tendered to
the City of Anaheim easement deeds covering the dedication of
rights of way to said Western Avenue; and
WHEREAS, the City Council finds that it is in the
best of interests of the City to accept said deeds and to make
payment to said defendants in the amount hereinafter set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that it accept, and it does hereby accept
the following easement deeds in favor of the City of Anaheim:
As to Parcel Six, an easement deed executed
by Robert D. Etchandy and Margaret Gay Etchandy;
As to Parcel Seven, an easement deed executed
by Albert J. Etchandy, Lois Alta Etchandy,
Robert D. Etchandy, and Margaret Gay Etchandy,
Dominic C. Etchandy, and Betty Jean Etchandy;
As to Parcel Eight, an easement deed executed
by Albert J. Etchandy; Lois Alta Etchandy;
Robert D. Etchandy; Margaret Gay Etchandy;
Dominic C. Etchandy; and Betty J. Etchandy;
that the City Clerk be, and she is hereby authorized and directed
to record said deeds.
BE IT FURTHER RESOLVED that the Finance Director be,
and is hereby authorized and directed to draw a city warrant
payable to Robert D. Etchandy and Margaret Gay Etchandy in
the amount of $1,408.00 and a city warrant payable to Albert
J. Etchandy, Lois Alta Etchandy, Robert D. Etchandy, Margaret
Gay Etchandy, Dominic C. Etchandy and Betty J. Etchandy in
the amount of $7,238.25; and that said warrants be delivered to
the Office of the City Attorney for transmittal. Said warrants
are to be charged against Work Order No. 5448.
THE FOREGOING RESOLUTION is approved and signed by me
this 8th day of April 19 69
