69R-159RESOLUTION NO.69R -159 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 68 -69 -72 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 1st day of A ri 1969 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 68 -69 -72 PARCEL 1. All that portion of the Northwest quarter of the Southwest quarter of Section 7, Township 4 South, Range 9 West, in the Rancho San Juan Cajon de Santa Ana, City of Anaheim, County of Orange, State of California, as shown on a map thereof recorded in Book 51, page 10, Miscellaneous Maps of Orange County, California, described as follows: Commencing at the intersection of the centerlines of Rio Vista Street and Anaheim Olive Road, now known as Lincoln Avenue, as said streets are shown on a Map of Survey recorded in Book 21, page 45 of Record of Surveys, in the Office of the County Recorder of said Orange County, and running thence South 0 19' 30" West, along the West line of the Northwest quarter of the Southwest quarter of said Section 7, 268.17 feet to the South line of said Northwest quarter of the Southwest quarter; thence North 89° 57' 45" East, along said South line, 45 feet to the true point of beginning; thence continue along said South line, 147.36 feet; thence North 0° 19' 30" East, 50.00 feet; thence South 89° 57' 45" West, 147.36 feet; thence South 0° 19' 30" West, 50.00 feet to the true point of beginning. PARCEL 2. All that portion of the Northwest quarter of the South- west quarter of Section 7, Township 4 South, Range 9 West, in the Rancho San Juan Cajon de Santa Ana, City of Anaheim, County of Orange, State of California, as shown on a map thereof recorded in Book 51, page 10 of Miscellaneous Maps, records of said Orange County, des cribed as follows: Commencing at the intersection of the center lines of Rio Vista Street and Anaheim -Olive Road, now known as Lincoln Avenue, as said streets are shown on a map of survey recorded in Book 21, page 45 of Record of Sur- veys in the Office of the County Recorder of said Orange County, and running thence South 0° 19' 30" West along the West line of the Northwest quarter of the Southwest quarter of said Section 7, 268.17 feet to the South line of said Northwest quarter of the Southwest quarter; thence North 89° 57' 45" East, along said South line, 192.36 feet to the true point of beginning of the land herein described; running thence North 89° 56' 45" East along said South line 140 feet; thence North 0° 19' 30" East to an intersection with a line parallel with and 53 Southwesterly of said center line of Lincoln Avenue; thence North 78° 55' 30" West, along said parallel line to an intersection with the East line of the land described in the Lease to Socony Mobil Oil Company, Inc. recorded August 6, 1962 in Book 6206, page 311, Official Records; thence South 0° 19' 30" West, along said East line and the Southerly extension thereof, to the true point of beginning. PARCEL 3. All that portion of the west quarter of Section West, in the Rancho San Northwest quarter of the South 7, Township 4 South, Range 9 Juan Cajon de Santa Ana, City of Anaheim, County of Orange, State of California, as shown on a map thereof recorded in Book 51, page 10, Miscellaneous Maps of Orange County, California, des- cribed as follows: Commencing at the intersection of the center lines of Rio Vista Street and Anaheim -Olive Road, now known as Lincoln Avenue, as said streets are shown on a Map of Survey recorded in Book 21, page 45 of Record of Sur veys, in the Office of the County Recorder of said Orange County, and running thence South 0° 19' 30" West, along the West line of the Northwest quarter of the Southwest quarter of said Section 7, 268.17 feet to the South line of said Northwest quarter of the Southwest quarter; thence North 89° 57' 45" East, along said South line, 332.36 feet to the true point of be- ginning of the land herein described; and running thence North 89° 57' 45" East, along said South line, 80 feet; thence North 0° 19' 30" East to an intersection with a line parallel with and 53 feet Southwesterly from said center line of Lincoln Avenue; thence North 78° 55' 30" West, along said parallel line to a point which bears North 0° 19' 30" East from the true point of beginning; thence South 0° 19' 30" West to the true point of beginning. PARCEL 4. All that portion of the Northwest quarter of the South- west quarter of Section 7, Township 4 South, Range 9 West, in the Rancho San Juan Cajon de Santa Ana, City of Anaheim, County of Orange, State of California, as shown on a map thereof recorded in Book 51, page 10 Miscellaneous Maps of Orange County, California, located southerly of a line parallel to and 53.00 feet South of the centerline of Lincoln Avenue, excepting the West 412.36 feet thereof. be excluded from R -A, AGRICULTURAL ZONE and incorporated in C -1, GENERAL COMMERCIAL ZONE, upon the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Lincoln Avenue, and a strip of land 45 feet in width, from the center line of the street, along Rio Vista Street, for street widening purposes. 2. (a) That all engineering requirements of the City of Anaheim along Lincoln Avenue and Rio Vista Street including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. ATTEST: 3. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Lincoln Avenue and Rio Vista Street, for street lighting purposes. 4. That the owner of subject property shall pay to the City of Anaheim the sum of 15 per front foot along Lincoln Avenue and Rio Vista Street, for tree planting purposes. 5. That a parcel map to record the approved division of subject property shall be submitted to the City of Anaheim for approval, and then recorded in the Office of the Orange County Recorder, prior to final building and zoning inspections. 6. That an 8 -foot masonry wall shall be constructed along the south property line of Parcels 2 and 3, prior to final building and zoning inspections. 7. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Super- intendent of Streets, prior to final building and zoning inspections. 8. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building and zoning inspections. 9. That all air conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent residential homes, prior to final building and zoning inspections. 10. That Conditions Nos. 1, 2(b), 3 and 4, above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. 11. That Ordinances reclassifying subject property shall be adopted as each parcel is ready to comply with the conditions pertaining to such parcel; PROVIDED, HOWEVER, that the word "parcel" shall mean presently existing parcels of record and any parcel or parcels approved for a lot split. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
