A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE
EXECUTION OF AN AGREEMENT BETWEEN THE CITY
OF ANAHEIM AND G. C. HEWITT COMPANY, WITH
REFERENCE TO IMPROVEMENTS AT THE ANAHEIM
STADIUM.
WHEREAS, the City Council does find and determine
that public convenience and necessity require the sandblasting
and repainting of the Big "A" Sign and the adjacent metal fence
at the Anaheim Stadium; and
WHEREAS, G. C. Hewitt Company has offered to furnish
all labor and material necessary to complete the sandblasting
and painting of the Big "A" Sign and adjacent metal fence at
the Anaheim Stadium in accordance with the proposal submitted
by said G. C. Hewitt Company under date of February 20, 1969
and signed by Robert J. Berg, Vice President, for the sum of
$33,833.00, with a five year warranty as outlined in a letter
of Skeehan Engineering Co., dated February 18, 1969, attached
to said proposal; and
WHEREAS, the City Council finds that said price is
the lowest obtainable for the furnishing of all labor and material
necessary to sandblast and repaint the Big "A" Sign and the
adjacent metal fence at the Anaheim Stadium, and that the offer
of G. C. Hewitt Company should be accepted.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the offer of G. C. Hewitt Company to
furnish all labor and material necessary to complete the sand-
blasting and painting of the Big "A" Sign and adjacent metal
fence at the Anaheim Stadium in accordance with the proposal
submitted by said G. C. Hewitt Company under date of February
20, 1969, and signed by Robert J. Berg, Vice President, for
the sum of $33,833.00, be, and the same is hereby accepted.
BE IT FURTHER RESOLVED that in the furnishing of all
labor and material to complete said sandblasting and repainting
at the Anaheim Stadium it shall be expressly understood and
agreed that said G. C. Hewitt Company is acting as an inde-
pendent contractor and not as an agent, servant or employee
of the City of Anaheim.
BE IT FURTHER RESOLVED that said G. C. Hewitt Company
shall carry public liability and property damage insurance in
an amount not less than $100,000.00 for injuries, including
accidental death, for any one person, and subject to the same
limit for each person in an amount not less than $300,000.00
on account of any one accident, and property damage insurance
in an amount not less than $50,000.00; and shall take out and
maintain during the life of said contract workmen's compensation
insurance covering all of its employees on the project; and
public liability and property damage insurance to cover vehicles
used or maintained by it in the performance of said work con-
nected with said improvement, with liability limits of not less
than $50,000.00 for any one person, and $100,000.00 for any one
accident, and property damage of $10,000.00.
That said G. C. Hewitt Company shall also furnish a
Faithful Performance Bond, and a Labor and Material Bond for
100% of the cost of said work.
BE IT FURTHER RESOLVED. that an agreement, in the
usual form approved by the City Attorney, be entered into
with G. C. Hewitt Company for the sandblasting and repainting
of said sign and fence at the Anaheim Stadium in accordance
with the proposal submitted by said G. C. Hewitt Company,
dated February 20, 1969; and that the Mayor and City Clerk be,
and they are hereby authorized to execute such agreement for
and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 25th day of March, 1969.
