A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING AN EASEMENT GRANT DEED
CONVEYING TO THE CITY OF ANAHEIM CERTAIN REAL
PROPERTY FOR AN EASEMENT FOR ROAD AND PUBLIC
UTILITY PURPOSES.
WHEREAS, the City Council of the City of Anaheim is
desirous of purchasing the hereinafter described real property
for municipal purposes, to wit: An easement for road and
public utility purposes
and
WHEREAS, the owners of said property have offered
to sell and convey the same to the City; and
WHEREAS, the City Council of the City of Anaheim finds
that it is for the benefit and best interest of the City of
Anaheim to accept said offer and purchase said real property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the offer of
JERRY VICTOR MALER, a single man; ISIDORO MALHER, a
single man; and CLARA MALHER, a single woman, brothers
and sister,
to sell to the City of Anaheim the following described real
property situated in the City of Anaheim, County of Orange,
State of California, to be used for an easement for road and
public utility purposes
and more particularly described as follows:
An easement for road and public utility purposes
over, under and across the Southerly 40 feet, as
measured at right angles to the centerline of
Lincoln Avenue, of that portion of the Southeast
quarter of the Southwest quarter of Section 7,
Township 4 South, Range 10 West, in the Rancho
Los Coyotes, as per Map recorded in Book 51,
page 10 of Miscellaneous Maps, records of said
County, described as follows: Beginning at the
Southwest corner of said Southeast quarter;
thence North 0 23' 03" West 370.00 feet along
the west line thereof to the north line of the
South 370.00 feet of said Southeast quarter;
thence North 88° 57' 30" East 299.05 feet along
said North line; thence North 1° 02' 30" West
75.00 feet; thence North 88° 57' 30" East 100.00
feet; thence South 1° 02' 30" East 75.00 feet
to said north line of the South 370.00 feet;
thence North 88° 57' 30" East along said north
line to the northerly prolongation of the
easterly line of the land described in the deed
to Jerry Victor Maler et al, recorded January
18, 1956 in Book 3359, page 249 of Official
Records; thence southerly along said prolongation
and said easterly line to the south line of said
Southeast quarter; thence South 88° 57' 30" West
to the point of beginning.
EXCEPTING THEREFROM any portion previously
dedicated to the State of California for public
highway purposes, per Instrument No. 43355 in
Book 4252, page 186 of Official Records of said
Orange County.
Note: For the purpose of this description, the
centerline of Lincoln Avenue is assumed to be the
south line of said Southeast quarter of the
Southwest quarter of said Section 7, Township 4
South, Range 10 West.
be, and the same is hereby, accepted by the City Council of the
City of Anaheim, and that the City of Anaheim accept a convey-
ance of said property.
BE IT FURTHER RESOLVED that the Director of Finance of
the City of Anaheim be, and he is hereby, authorized to pay to the
owner or owners of said real property, out of General Funds of
the City of Anaheim, the sum of One Dollar ($1.00).
THE FOREGOING RESOLUTION is approved and signed by me
