A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM RECOMMENDING LEGISLATION WHICH
WOULD PREVENT STATE AGENCIES FROM PRE- EMPTING
THE FIELD OF LOCAL BUILDING REGULATIONS.
WHEREAS, the City Council of the City of Anaheim is
concerned over recent State legislation which could result in
the State of California pre empting the field of building
regulations on a loc 1 level; -and
WHEREAS, this City is a strong advocate of the "Home
Rule" concept; and
WHEREAS9.this City is concerned over the fact that
in some case: local governing bodies are not permitted to
designate which agency or division within its govrnment shall
be the enforcement =.gency for any given State Agency regula-
tion which is delegated to a local jurisdiction for enforce-
ment.
NOW THEREFORE, BE IT RESOLVED that the City Council
of the City of Anaheim urges the introduction and adoption of
amendments to the State Health and Safety Code for the purpose
of:
(1) retaining for local governing bodies the
option of adopting and enforcing building
regulations in lieu of similar State re-
gul, -tions provided minimum standards are
maintained equivalent to that prescribed
in the State re_; lations; and providing
that any local Igency which adopts the
nationally recognized codes specifi d in
Chapter 17922 of the California Health and
Safety Code would automatically be deemed
to have regulations equiv:lent to the re-
gulations promulgated by the State Division
of Housing.
(2) providing that local governing bodies should
be permitted to designate the local enforce-
ment agency whenever a State Agency regula-
tion is delegated to a local jurisdiction
for enforcement; and
BE IT FURTHER RESOLVED that th City Clerk of the
City of Anaheim be directed to trans it a certified copy of
this resolution to the Gov:-rnor of the State of California,
California State Legislators from the County of Orange,
each member of the State Building Standards Commission and
to the City Councils of each Orange County City.
