63-0907RESOLUTION NC. 63R -907 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 283. WHEREAS, The City Planning Commission of the City of Anaheim did receive an application for a Conditional Use Permit from MORTIN G. RODIN, 252 S. Robertson, Beverly Hills, Cali- fornia, to amend original Conditional Use Permit No. 283 by granting a waiver of the garage requirement, to permit the construction of carports; a waiver of the required lot width; required lot area; and required access to lots from public streets or alleys, on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: Parcel 1. The north half of the southeast quarter of the southeast quarter of the northeast quarter of section 27, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, City of Anaheim, County of Orange, State of California, as per map recorded in Book 51 Page 10 of Miscel- laneous Maps, in the office of the County Recorder of said county. EXCEPT the north 150.00 feet of the east 150.00 feet thereof. Parcel 2. The north 150.00 feet of the east 150.00 feet of the north half of the southeast quarter of the southeast quarter of the northeast quarter of Section 27, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, City of Anaheim, County of Orange, State of California, as per map recorded in Book 51 Page 10 of Miscellaneous Maps, in the office of the County Recorder of said County. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on September 16, 1963, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 911 Series 1963-64, granting Conditional Use Permit No. 283 in part, as more particularly set forth in said resolution, and subject to certain conditions stated therein; and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission requiring that the interior of the pro- posed carports be finished, and said appeal was set for public hearing on November 12, 1963, at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given -1- as required by law and the provisions of' Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said publ is hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evid ence and reports; and WHEREAS, the City Counci 1 finds, after careful considera- tion of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The the th e the granting of the Conditional Use Permit under conditions imposed will not be detrimental to peace, health, safety and general welfare of citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of the City of Anahe im that the action of the City Planning Com- mission granting said Conditional Use Permit in part be, and the same is hereby sustained, and that Conditional Use Permit No. 283 be, and the same is hereby, granted permitting the constructi on of carports in lieu of garages on the property here inabove described, sub jrt to the following conditions; That the rear shall be fini that enclosed of 36 inche s entire width the rear wal 1 guards shall of the carp or be completed and side walls of the proposed carports shed with exterior building materials; storage cabinets of a minimum size by 14.2 inches in height, and running the of each carport, shall be provided at of the carport; that adequate bumper be provided to protect the interior walls ts; and that al 1 of said items shal 1 prior to final building inspection. BE IT FURTHER RESOLVED that the request of the applicant for a waiver of the requirement to finish the interior of the carports be, and the same is her eby denied. -2 The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
