63-0915RESOLUTION NO. 63R -915 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 63 -64 -33 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 19th day of November 19 63 as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 63 -64 -33 PARCEL 1. That portion of lot 26 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, as shown on a map of survey made by William Hamel and filed in the Office of the County Recorder of Los Angeles County, California, a copy of which is shown in Book 3, pages 163 et seq., entitled "Los Angeles County Maps," in the office of the County Recorder of said Orange County, described as follows: Beginning at a point on the northeasterly line of said lot 26, 323.19 feet North 15 32' 15" West from the southeast corner of said lot 26, said southeast corner being the intersection of the center line of Los Angeles Street with the center line of Ball Road as shown on said map; thence North 15 32' 15" West along the northeasterly line of said lot 26 to a point 120.00 feet southeasterly of the northwesterly line of that certain parcel of land described in deed recorded November 18, 1946 in Book 1456, page 555 of Official Records of said Orange County; thence South 74 20' 15" West, parallel with said northwesterly line, 200.00 feet; thence South 15 32' 15" East, parallel with the north- easterly line of said lot, 60.00 feet; thence North 74 20' 15" East 200.00 feet to the point of beginning. PARCEL 2. That portion of lot 26 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, as shown on a map of survey made by William Hamel and filed in the Office of the County Recorder of Los Angeles County, California, a copy of which is shown in Book 3, pages 163 et seq., entitled "Los Angeles County Maps," in the Office of the County Recorder of said Orange County, described as follows: Beginnin§ at a point on the east line of said lot North 15 32' 15" West 323.19 feet from the southeast corner of said lot, said southeast corner being the point of intersection of the center line of Los Angeles Street with the center line of Ball Road, as said streets are shown on said map; thence South 74 20' 15" West 230.00 feet to a point on the northeasterly line of Parcel 1 in the deed to Werner R. Stoll and wife recorded March 13, 1950 in Book 1983, page 592 of Official Records of said Orange County; thence South 15 32' 15" East along said northeasterly line 110.00 feet to an angle point therein; thence North 74 20' 15" East along the northwesterly line of Parcel 2 in said deed to Werner R. Stoll and wife and its southwesterly extension 230.00 feet to a point on the northeasterly line of said lot 26, said point being the most northerly corner of said Parcel 2 in said deed to Werner R. Stoll and wife; thence North 15 32' 15" West along the northeasterly line of said lot 26, 110.00 feet to the point of beginning. be excluded from C -1, NEIGHBORHOOD COMMERCIAL ZONE, and incor- porated in the following zones, upon the conditions hereinafter set forth: That the remainder of subject property shall be changed to and incorporated in C -3, HEAVY COMMERCIAL ZONE. That said change of zones shall be made upon the following conditions: 1. Thattrash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 2. That any plans for the development of subject property shall be submitted to the City Council for review and approval prior to the issuance of a building permit. 3. That tree wells shall be provided at approximately 40 -foot intervals in the Los Angeles Street parkway abutting subject property; that plans for said tree wells and the plantings therein shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said tree wells shall be planted prior to final building inspection. 4. That plans for landscaping the six -foot P -L, PARKING LANDSCAPING ZONE area shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper. THE FOREGOING RESOLUTION is signed and approved by me this 19th day of November, 1963.
