63-0968RESOLUTION NO 63R -968 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending denial of said proposed change in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 3rd day of December 1963, as the time, and the City CUUFFil Chambers in the City Hall the City of Anaheim as the place for a public hearing upon said proposed amendment to Title ld of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone in which it is now situated and the incorporation thereof in the zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendations; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: 63 -64 -46 The south 252.00 feet of the north 318.00 feet of the east half of the east half of the north- west quarter of the northwest quarter of Section 14, Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as per map recorded in Book 51, page 11 of Miscellaneous Maps, in the office of the County Recorder of said County. EXCEPT the east 1.00 feet thereof. be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incor- porated in C -1, NEIGHBORHOOD COMMERCIAL ZONE, upon the following conditions: 1. That the existing 20 -foot alley to the south of subject property shall be extended to Lincoln Avenue, either on subject property or in con- junction with the adjacent property to the east. 2. That adequate trash storage facilities shall be provided at the southwest corner of subject property, in addition to the area near the south- east corner as shown on Exhibit No. 1, Revision No. 1; that said trash storage areas shall con- form to approved plans for such areas on file in the Office of the Director of Public Works and Superintendent of Streets, and shall be construc- ted prior to final building inspection. 3. That the owner of subject property shall deed to the City of Anaheim an area for a modified cul -de- sac at the terminus of Bella Vista Street as required by the City Engineer. 4. (a) That all engineering requirements of the City of Anaheim along Lincoln Avenue and Bella Vista Street, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 5. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Lincoln Avenue, for street lighting purposes. 6. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim, marked "Exhibit No. 1, Revision No. 1," and stamped and signed on December 2, 1963, by Mayor Coons. 7. That tree wells shall be provided at approximately 40 -foot intervals in the Lincoln Avenue parkway abutting subject property; that plans for said tree wells and the plantings therein shall be approved by the Superintendent of Parkway Maintenance; and that said tree wells shall be planted with trees prior to final building inspection. 8. That a 6 -foot strip of land shall be landscaped on the Lincoln Avenue frontage, and said landscaping maintained, as indicated on Exhibit No. 1, Revision No. 1; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 9. That all air conditioning facilities shall be con tained within the building or properly shielded from view. 10. That the parking area and the entranceway to the building shall be landscaped as indicated on Exhibit No. 1, Revision No. 1; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 11. That the owner of subject property shall deed to the City of Anaheim all access rights to Bella Vista Street. 12. That a 6 -foot masonry wall, or wall of equivalent material, shall be constructed around the periphery of the Bella Vista cul -de -sac, except for openings for pedestrian access, which wall shall be construc- ted prior to final building inspection. 13. That Conditions Nos. 3, 4(b), 5 and 11 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
