A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACKNOWLEDGING OBLIGATION OF PRO-
TECTION OF LINES OF FOUR CORNERS PIPE LINE
COMPANY AND AUTHORIZING THE CITY ATTORNEY TO
OBLIGATE THE CITY OF ANAHEIM FOR NECESSARY
PROTECTIVE MEASURES TO BE CONSTRUCTED.
WHEREAS, the City of Anaheim has obtained an easement
for the construction of a water transmission line from the
Santiago Land Co. and Burruel Land Company, which easement is
contemplated for ultimate use as an extension of Lincoln Avenue;
and
WHEREAS, such easement to the City of Anaheim is sub-
ject to and subordinate to the rights of the Four Corners Pipe
Line Company in an existing easement crossing said easement of
the City of Anaheim for pipelines for the transmission of oil
and hydrocarbon products; and
WHEREAS, the use of the easement contemplated by the
City of Anaheim will require the construction of protective
measures to protect the existing pipelines of the Four Corners
Pipe Line Company; and
WHEREAS, the Four Corners Pipe Line Company has agreed
to install such necessary protective measures at the cost of the
City of Anaheim but said construction to be performed by the
contractors of said Four Corners Pipe Line Company under their
supervision.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the City acknowledges its obligation to
provide necessary protection to the Four Corners Pipe Line Com-
pany and its existing pipelines to prevent the uses to be made
by the City of Anaheim in the exercise of its subordinated ease-
ment from constituting a burden upon the existing rights of use
of said Four Corners Pipe Line Company.
BE IT FURTHER RESOLVED that the City Attorney of the
City of Anaheim is authorized and directed to request the Four
Corners Pipe Line Company to construct the necessary protective
devices to protect their pipelines from the projected use of
the City of Anaheim and to incur the obligation of the City of
Anaheim in connection with such measures so that upon the com-
pletion of installation by said Four Corners Pipe Line Company
the City of Anaheim will be obligated to pay or reimburse the
Four Corners Pipe Line Company for all expenditures made for
such protective measures constructed for their existing pipelines.
THE FOREGOING RESOLUTION is approved and signed by me
this 10th day of December, 1963.
