RESOLUTION NO. 66R- 50
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AMENDING RESOLUTION NO.
65R-759 GP~NTING CONDITIONAL USE PERMIT
NO. 747.
WHEREAS, the City Council did heretofore, to wit, on
October 5, 1965z adopt Resolution No. 65R-759 granting Conditional
Use Permit No. /47 permitting"the establishment of a doctor's
office in an existing residential structure, and permitting
waivers of (1) the minimum site area; (2) the required 6-foot
block wall between commercial and residential zones; (3) the
required 3-foot screen planting adjoining the right of way; and
(4) the required 21 minimum landscaping in parking areas, on the
property described -in said resolution, subject to certain condi-
tions therein set forth; and ,
WHEREAS, due to a clerical error in the preparation of
said resolution it was stated that said permit granted a waiver
of the required 3-foot screen planting adjoining the right of
way, when, in fact, it was the intention of the City Council that
the request for said waiver be denied; and
WHEREAS, due to a further clerical error in the pre-
paration of said resOlution, the conditions inserted therein as
the conditions subject to which said permit was granted, were
not the conditions imposed by the City Council in the granting
of Conditional Use Permit No. 747; and
WHEREAS, the City Council finds that Resolution No.
65R-759 should, therefore, be amended by deleting Item (3) from
the waivers granted and by denying the request for said waiver,
and should be further amended by deleting Conditions Nos. 1 and
2 inserted in said resolution in error, and substituting therefor
the conditions imposed by the City Council and hereinafter set
forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Resolution No. 65R-759 granting Condi-
tional Use Permit No. 747 be, and the same is hereby amended as
follows:
(a)
That Item (3) of the waivers permitted, reading as
follows:
"(3) the required 3-foot screen planting adjoining
the right of way"
be deleted, and that said waiver be, and the same is
hereby denied.
(b) That Conditions Nos. 1 and 2, reading as follows:

"1. That the existing structure on subject property
shall conform to the Uniform Building Code as
adopted by the City of Anaheim for commercial
structures; and that all required alterations
shall be completed prior to final building
inspection.

"2. That a 6-foot decorative, masonry wall shall be
constructed along the Fairhaven Street frontage
of subject property, which wall shall be set
back three (3) feet from the property line; that
the 3-foot strip of land between the sidewalk
and said masonry wall shall be landscaped; that
plans for said landscaping shall be submitted to
and approved by the Superintendent of Parkway
Maintenance; and that said landscaping shall be
installed prior to final building inspection."

condit1onsbe substituted therefor:
That this conditional use permit is granted
subject to the completion of Reclassification
Proceedings No. 65-66-34 now pending.
That trash storage areas shall be provided in
accordance with approved plans on file in the
Office of the Director of Public Works and
Superintendent of Streets, prior to final
building inspection.
That subject property shall be developed sub-
stantially in accordance with plans and specifi-
cations on file with the City of Anaheim,
marked Exhibits Nos. 1 through 6; provided
however, that the required 3-foot screen pianting
adjoining the right of way along Claremont Street
shall be provided."
BE IT FURTHER RESOLVED that in all other respects
said Resolution No. 65R-759 be, and remain in full force and
effect.
