69R-091RESOLUTION NO. 69R -91 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING A SEALED PROPOSAL AND AWARDING A CONTRACT TO THE LOWEST RESPONSIBLE BIDDER FOR THE FURNISHING OF SOUND SYSTEM COMPONENTS FOR THE ANAHEIM CONVENTION CENTER, 800 WEST KATELLA AVENUE, ANAHEIM, WORK ORDER NO. 338. WHEREAS, the City Council of the City of Anaheim did cause to be published in a newspaper of general circulation, printed, published and circulated in the City of Anaheim, to wit: The Anaheim Bulletin, on January 30th and February 6th, 1969, a notice inviting sealed proposals for the furnishing to the City of Anaheim of the following materials in the quanti- ties, sizes, etc., as set forth in the specifications on file in the Office of the City Clerk or City Engineer: Sound system components for the Anaheim Con- vention Center, 800 West Katella Avenue, in the City of Anaheim, consisting of speakers, amplifiers, meters, panels, transformers, microphones, earphones, switches, wire, turn- table with changer, receptacles, plugs, tape recorder, and all other materials as set forth in the bid proposal and specifications on file in the Office of the City Clerk or City Engineer, Work Order No. 338. AND WHEREAS, said notice did provide that said materials for said sound system shall be in accordance with specifications on file in the Office of the City Clerk or City Engineer; and WHEREAS, such notice inviting proposals for said sound system components did provide that said sealed proposals would be received by the City of Anaheim at the Office of the City Clerk of said City up to the hour of 2 :00 o'clock P.M. on February, 13, 1969, for the furnishing to said City of said sound system components for the Anaheim Convention Center; and WHEREAS, the City Clerk of the City of Anaheim did receive sealed proposals prior to 2 :00 o'clock P.M. on February 13, 1969, for the furnishing of said sound system components, which proposals were opened on said date in public, in the City Council Chambers in the City Hall, in the City of Anaheim by the City Clerk and the City Engineer, and duly tabulated by the City Engineer and the result thereof reported to the City Council at its next regular meeting, for action thereon by said City Council. That sealed proposals were received from the fol- lowing persons, firms or corporations in the amounts set forth: TOTAL PRICE (Delivered Anaheim Convention Center) NAME ITEM NO. FAIRFAX ELECTRONICS, INC. as itemized in proposal on file in Office of City Clerk Plus 5% State and City Sales Tax Total Delivered Price 24,700.84 23,524.61 1,176.23 NAME HANNON ENGINEERING, INC. ITEM NO. as itemized in proposal on file in Office of City Clerk TOTAL PRICE (Delivered Anaheim Convention Center) 33,155.88 Plus 5% State and City Sales Tax 1,657.79 Total Delivered Price 34,813.67 AND WHEREAS, the City Council does find that the sealed proposal of FAIRFAX ELECTRONICS, INC., 4527 West Adams Boulevard, Los Angeles, California 90016, is the lowest responsible bid for the furnishing of sound system components for the Anaheim Conven- tion Center as specifided in the notice inviting sealed proposals and in accordance with the specifications therefor, and that said proposal of Fairfax Electronics, Inc. should be accepted and a contract awarded to said company for furnishing of said sound system components for the Anaheim Convention Center. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that said proposal submitted by Fairfax Electronics, Inc. for the furnishing of sound system components for the Anaheim Convention Center, as specified in the notice inviting sealed proposals therefor and in accordance with and conformity to the specifications on file in the. Office of the City Clerk be, and the same is hereby, accepted and that a contract for the fur- nishing of said sound system components be, and the same is hereby awarded to said Fairfax Electronics, Inc.; and BE IT FURTHER RESOLVED that the award of a contract to said Fairfax Electronics, Inc. is declared to be for the approxi- mate quantities set forth in the notice inviting sealed proposals and that the actual amounts required by the City may be substan- tially more or less than these amounts; and BE IT FURTHER RESOLVED that said Fairfax Electronics, Inc. be, and it is hereby required to execute a contract, in required form satisfactory to the City of Anaheim and upon the terms and conditions specified in the notice inviting sealed proposals and the proposal submitted by it, and in accordance with the specifications for said sound system components at the prices set forth in the proposal submitted by it and on file in the Office of the City Clerk; and BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that said bid be, and the same is hereby accepted and said contract awarded for the prices for said sound system components as listed on the accepted proposal on file in the Office of the City Clerk, for delivery to the Anaheim Convention Center, plus State and City Sales Tax, said sound system components to be delivered as required by the City of Anaheim within sixty days after the execution and delivery of an executed copy of said contract to said Fairfax Electronics, Inc.; and BE IT FURTHER RESOLVED that the Mayor and City Clerk of the. City of Anaheim be, and they are hereby authorized and directed to execute for and on behalf of the City of Anaheim with said Fairfax Electronics, Inc. a written contract for the fur- nishing of said sound system components in accordance with the specifications, the notice inviting sealed proposals and the terms of this resolution, and the contract approved by the City Attorney of the City of Anaheim; and BE IT FURTHER RESOLVED that said contract shall con- tain a provision that should said Fairfax Electronics, Inc. fail or neglect to furnish said sound system components in accordance with said specifications and the sealed proposal submitted by it and accepted by the City as herein specified, it shall, in addi- tion to any other penalties provided in the contract documents, be liable to the City of Anaheim for all loss or damages that the latter may suffer on account thereof.
