66-147 - RESOLUTION NO. 66R-141 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 1156. .- WHEREAS, the City Planning Conmission of the City of Anaheim did receive a petition for zoning variance from ORANGETHORPE PARK, owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Those portions of Tract No. 613, as shown on a Map re- corded in Book 19, page 19 of Miscellaneous Maps, records of Orange County, California. Parcell: Beginning at a point in the South line of said Tract No. 613, said point being 624.54 feet North 130 12' East from the Southwest corner of said Tract No. 613; running thence North 10 15' West 1215.10 feet to a point in a line described as follows: Beginning at a point located 685.30 feet North 810 19' West and 218.34 feet South 10 151 East from the Northeast corner of said Tract No. 613; running thence South 150 20' West to a point in the Westerly line of said Tract No. 613, said point being 510.00 feet South 180 11' West from the most Northwest corner of said Tract No. 613; thence North 150 20' East 201.38 feet, along the said described line; thence South 10 15' East 1208.11 feet to a point in the South line of said Tract No, 613; thence South 130 12' West 202.50 feet to the point of beginning. Excepting therefrom the Southerly 20 feet, as conveyed to the County of Orange, for road purposes, by deed recorded February 24, 1926 in Book 626, page 381 of Deeds. Parcel 2: Beginning at a point in the South line of said Tract No. 613, said point being 423.36 feet North 130 12' East from the Southwest corner of said Tract No. 613; running thence North 10 15' West 1223.20 feet to a point in a line described as follows: Beginning at a point located 685.30 feet North 810 19' West and 218.34 feet South 10 15' East from the Northeast corner of said Tract No. 613; running thence South 150 20' West to a point in the Westerly line of said Tract No. 613, said point being 510.00 feet South 180 11' West from the most Northwest corner of said Tract No. 613; thence North 150 20' East 200.01 feet along the said described line; thence South 10 15' East 1215.10 feet to a point in the South line of said Tract No. 613; thence South 130 12' West 201.18 feet to the point of beginning. Excepting therefrom the Southerly 20 feet, as conveyed to the County of Orange, for road purposes by deed recorded February 24, 1926 in Book 626, page 381 of Deeds. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on January 11, 1966, notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.16 of the Anaheim Municipal Code; and -1- - WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 1907, Series 1965-66, granting variance No. 1756; and -. WHEREAS, thereafter within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in granting said variance and did set a public hearing thereon to be held on the 23rd day of February, 1966, at 7:00 o'clock P. M. in the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the_City Council does find and determine that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. NOW, THEREFORE, BE IT RESOLVED by the City .Council of the City of Anaheim that the action of the City Planning Com- mission granting Variance No. 1756 be, and the same is hereby, disapproved, and that the petition for a conditional zoning variance permitting waivers of the maximum structural height limitation within 150 feet of an R-A, Agricultural Zone, and the requirement of an alley at the rear of a multiple family development, on the property hereinbefore described, ~e, and the same is hereby denied.
