69R-056RESOLUTION NO. 69R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES' OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 68 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 8th day of Jarjuary 19 gg as the time, and the City Council Chambers in the City Hail of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 68 -69 =59 That portion of the Northwest quarter of the Southwest quarter of Section 7, Township 4 South, Range 9 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, County of Orange, State of California, as per map recorded in book 51, page 10 of Miscellaneous Maps in the office of the County Recorder of said County, described as follows: Beginning at the intersection of the center line of Anaheim -Olive Road as described in the deed recorded May 17, 1915 in Book 275, page 85 of Deeds, with the Westerly line of said Section 7; thence along said center line South 78 55' 30" East 434.76 feet to the true point of beginning; thence continuing along said centerline South 78° 55' 30" East 246.03 feet to the Westerly line of the land described in the deed to the State of California recorded November 5, 1948 in book 1725, page 422 of Offi- cial Records; thence North 11° 04' 55" East 69.80 feet to the Northwest corner of said land of the State of California; thence along the Northerly line of said land of the State of California South 78° 54' 38" East 649.96 feet to the Easterly line of the Northwest quarter of the Southwest quarter of said Section 7; thence along said Easterly line North 0° 09' 50" East 754.64 feet to the Northerly line of the South half of the South half of the North half of the Northwest quarter of the Southwest quarter of said Section 7; thence along said Northerly line South 89° 49' 50" West 1319.93 feet to said Westerly line of said Section 7; thence Southerly along said Westerly line to a line parallel with and distant Southerly 30.00 feet from said last mentioned Northerly line; thence along said parallel line North 89° 49' 50 East 427.12 feet to a line parallel with said Westerly line of said Section 7 and which passes through the true point of be- ginning; thence Southerly along said parallel line 587.88 feet to the true point of beginning. EXCEPT the Easterly 535.00 feet, measured at right angles of said land. be excluded from R -A, AGRICULTURAL ZONE and incorporated in R -3, MULTIPLE -FAMLY RESIDENTIAL ZONE, upon the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street along Rio Vista Street, for street widening purposes, and shall also deed to the City of Anaheim an easement for road and public utility purposes for a new street over a por- tion of the westerly 57 feet of the Easterly 58 feet of subject property, including a standard 50 -foot radius cul -de -sac at the Northerly terminus of the new street. 2. That the new street shall be developed with a 40 -foot roadway, a standard 12 -foot parkway on the west side, and a 5 -foot parkway on the east side; and that the east side parkway shall be full concrete, with tree wells and irrigation facilities provided as required by the Superintendent of Parkway Maintenance. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper. THE FOREGOING RESOLUTION is approved and signed by me this 28th day of January, 1969. ATTEST: 3. (a) That all engineering requirements of the City of Anaheim along Rio Vista Street and the new street above mentioned, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 4. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Lincoln Avenue, Rio Vista Street and the new street above mentioned, for street lighting purposes. 5. That the owner of subject property shall pay to the City of Anaheim the sum of 15 per front foot along Lincoln Avenue, Rio Vista Street and the new street above mentioned, for tree planting purposes. 6. That the owner of subject property shall dedicate to the City of Anaheim public utility easements as re- quired by the Utilities Department. 7. That .arrangements shall be made for the disposal of drainage in a manner satisfactory to the City Engineer. 8. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per apartment unit, to be used for park and recreation purposes, said amount to be paid prior to the servicing with utilities or final building and zoning inspections; PROVIDED, HOWEVER, that in the event said amount shall not have been paid by May 1, 1969, there shall be due and pay able prior to the servicing with utilities or final building and zoning inspections the sum of $75.00 per apartment unit. 9. That Conditions Nos. 1, 2, 3(b), 4, 5, 6 and 7 above Mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant.
