69R-054RESOLUTION NO. A RESOLUTION OF THE CITY CITY OF ANAHEIM GRANTING PERMIT NO. 1081. PARCEL TWO 69R -54 COUNCIL OF THE CONDITIONAL USE WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from Geraldine M. Suda, et al 3352 West Lincoln Avenue, Anaheim, California 92801, to establish a 245 -unit motel on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: PARCEL ONE The East one acre of that portion of the East half of the Northwest quarter of the Northwest quarter of Sec- tion 14, Township 4 South, Range 11 West, San Bernadino Base and Meridian, in the City of Anaheim, County of Orange, State of California, described as follows: Beginning at the Northwest corner of the East half of the Northwest quarter of the Northwest quarter of said Section 14; thence East along the North line of said Section 14, a distance of 330 .feet;. thence South parallel to the West line of the East half of the Northwest quarter of the Northwest quarter of said Section 14, a distance of 660 feet; thence West parallel to the North line of said Section 14, a distance of 330 feet to a point on the West line of said East half of the North- west quarter of the Northwest quarter of said Section 14; thence North along said West line, 660 feet to the point of beginning. EXCEPTING THEREFROM the Northerly 66 feet thereof as conveyed to the State of California, by deed recorded August 2, 1955, in Book 3159, page 98, Official Records in the office of the County Recorder of said Orange County. That portion of the East half of the Northwest quarter of the Northwest quarter of Section 14, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as per map recorded in Book 51, page 7, et seq., of Mis- cellaneous Maps, in the office of the County Recorder of said county, described as follows: Beginning at the Northwest corner of the East half of the Northwest quarter of the Northwest quarter of said Section 14, and running thence East along the North line of said Section 14, 330.00 feet; thence South parallel with the West line of the East half of the Northwest quarter of the Northwest quarter of said Section 14, 660.00 feet; thence West parallel with the North line of said Section 14, 330.00 feet to a point on the West line of said East half of the Northwest quarter of the Northwest quarter of Section 14; thence North along said West line, 660.00 feet to the point of beginning. EXCEPT THEREFROM the West 2 acres. ALSO EXCEPT THEREFROM the East 1 acre. ALSO EXCEPT THEREFROM the North 66 feet thereof. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on December 30, 1968, notices of which said public hearing were duly given as required by law and the pro visions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. PC68 -376 granting Conditional Use Permit No. 1081, subject to the conditions there- in set forth; and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said conditional use permit and did thereupon fix the 28th day of January, 1969, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said conditional use permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City. Council finds, after careful con sideration of the recommendations of the City. Planning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion in granting said conditional use permit be, and the same is hereby sustained, and that Conditional Use Permit No. 1081 be, and the same is hereby, granted permitting the establishment of a 245 -unit motel (Section 18.40.060[f] of the Anaheim Munici- pal Code) on the property hereinbefore described, subject to the following conditions 1. That this conditional use permit is granted subject to the completion of Reclassification Proceedings No. 68- 69 -57, now pending. 2. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of. Streets. 3. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 4. That a 6 -foot masonry wall shall be constructed along the south and east property lines. 5. That arrangements shall be made for the disposal of drainage in a manner satisfactory to the City Engineer. 6. That all air conditioning facilities shall be properly shielded from view. 7. That the parking areas shall be lighted with down lighting of a maximum height of six (6) feet, and said lighting shall be directed away from the property lines to protect the residential integrity of the area. 8. That Conditions Nos. 2, 3, 4, 5, 6, and 7, above mentioned,shall be complied with prior to final building and zoning inspections. 9. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 2, 3, 4, 5, 6 and 7; PROVIDED, HOWEVER, that kitchen efficiency units with a maximum of 6 -cubic foot refriger- ators, two- burner stoves, excluding oven and baking facilities, and single compartment sinks, may be pro- vided; with the exception that the manager's unit will be allowed full kitchen facilities. The City Council hereby reserves the right to revoke such conditional use permit for good cause or failure of said owners, their heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein.
