A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE
EXECUTION OF UTILITIES AGREEMENT NO. 7UT -4145
WITH THE STATE OF CALIFORNIA, TO PROVIDE A
REPLACEMENT WATER SOURCE FOR PRIVATELY -OWNED
WATER SYSTEMS NECESSITATED BY CONSTRUCTION
OF THE RIVERSIDE FREEWAY, ROAD 07- ORA -91
9.2/13.9 (ROUTE 55/91 INTERCHANGE AND 0.5
MILE EAST OF EUCALYPTUS DRIVE)
WHEREAS, construction of the Riverside Freeway, Road
07- Ora -91 9.2/13.9, requires installation of a replacement
water source for privately -owned water systems required to be
cleared for freeway construction; and
WHEREAS, the cost of materials only for installation
of said replacement water source is to be advanced by the State,
because the State is required to relocate or provide an
alternate source of water because of prior water pipe line
rights, recorded August 1, 1939, in Book 1002, page 530; and,
January 25, 1963, in Book 6408, page 106, both of Official
Records of Orange County; and
WHEREAS, the State of California, Department of Public
Works, Division of Highways, has submitted to the City Council
Utilities Agreement No. 7UT -4145, to be made and entered into
by and between the City and the State providing for installa-
tion of a replacement water source for privately -owned water
systems required to be cleared for construction of the
Riverside Freeway, Road 07- Ora -91 9.2/13.9, as more particularly
set forth in said agreement, the work to be performed by the
City, and the cost of materials only, estimated at $28,000,
to be advanced by the State, upon the terms and conditions
and in accordance with the procedure set forth in said agreement;
and
WHEREAS, the City Council finds that it would be for
the benefit and best interest of the City to enter into said
agreement with the State of California.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that Utilities Agreement No. 7UT -4145,
this day submitted to the City Council by the State of
California, Department of Public Works, Division of Highways,
to be made and entered into by and between the City and the
State providing for installation of a replacement water source
for privately -owned water systems required to be cleared for
construction of the Riverside Freeway, Road 07- Ora -91 9.2/13.9,
as more particularly set forth in said agreement, the work
to be performed by the City, and the cost of materials only,
estimated at $28,000, to be advanced by the State, upon the
terms and conditions and in accordance with the procedure set
forth in said agreement, be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby authorized to execute said agreement
for and on behalf of the City of Anaheim.
