69R-007RESOLUTION NO. 69R -7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 68 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 7th day of Janu4ry 19 69 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 68 -69 -52 PARCEL 1: That portion of the West half of the Southeast Quarter of the Southwest quarter of Section 7, Township 4 South, Range 10 West, of the Rancho Los Coyotes, in the City of Anaheim, County of Orange, State of California, as shown on a map recorded in Book 51, page 10 of Miscel- laneous Maps, records of said County described as follows: Beginning at the Southwest corner of said Southeast Quarter of Southwest Quarter; thence along the Westerly line thereof, North 0° 23' 29" West 370.02 feet to the Southerly line of the land of the Anaheim Union High School District as per Condemnation Proceedings recorded in Book 5493, page 515 of Official Records of said county; thence thereon parallel with the South line of said section, North 88° 58' East 519.08 feet; thence South 0° 39' 57" East 370.00 feet to the point in said South line of Section 7, said point being North 88° 58' East and distant 520.66 feet from the point of beginning; thence along said South line of Section 7 South 88° 58' West 520.85 feet to the point of beginning. PARCEL 2: That portion of the West half of the Southeast Quarter of the Southwest Quarter of Section 7, Township 4 South, Range 10 West, of the Rancho Los Coyotes, in the City of Anaheim, County of Orange, State of California as shown on a map recorded in Book 51 page 10, of Miscellaneous Maps, records of said county described as follows: Beginning at the Southwest corner of said Southeast Quarter of Southwest Quarter; thence along the Westerly line thereof, North 0° 23' 29" West 370.02 feet to the Southerly line of the land of the Anaheim Union High School District as per Condemnation Proceedings recorded in Book 5493 Page 515 of Official Records of said county; thence thereon parallel with the South line of said Section North 88° 58' East 299.05 feet to the true point of beginning; thence at right angles North 01° 02' West 75.00 feet; thence parallel with said Southerly line of Section 7 North 88° 58' East 100 feet; thence at right angles South 01° 02' East 75.00 feet; thence South 88° 58' West 100 feet to the true point of beginning. be changed from R -A, AGRICULTURAL ZONE, and incorporated in R -3 MULTIPLE FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 40 feet in width, from the center line of the street, along Lincoln Avenue for street widening purposes. 2. (a) That all engineering requirements of the City of Anaheim along Lincoln Avenue, including preparation of improvement plans and installation of all improve- ments, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 3. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Lincoln Avenue, for street lighting purposes. 4. That a parcel map to record the approved division of subject property shall be submitted to the City of Anaheim for approval and then recorded in the Office of the Orange County Recorder. 5. That the owners of subject property shall pay to the City of Anaheim the sum of 15 per front foot along Lincoln Avenue for tree planting purposes. 6. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets. 7. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 8. That a strip of land 35 feet in width along the Lincoln Avenue frontage shall be landscaped, and said landscaping maintained, as indicated on Exhibit No. 1 on file with the City of Anaheim; and that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance. 9. That 6 -foot masonry walls shall be constructed along the west, north and east property lines, where car- ports are not constructed adjacent to these property lines, and that said walls shall be stepped down to 42 inches in height in the 35 -foot Lincoln Avenue set- back area. 10. That all air conditioning facilities shall be properly shielded from view and the sound buffered from adja- cent residential homes. 11. That the owners of subject property shall pay to the City of Anaheim the sum of $150.00 per apartment unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 12. That the parking areas shall be lighted with down lighting of a maximum height of six (6) feet, and said lighting shall be directed away from the property lines to protect the residential integrity of the area. 13. That Conditions Nos. 1, 2(b), 3 and 5 above- mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. 14. That Conditions Nos. 4, 6, 7, 8, 9, 10, and 12, above mentioned shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
