RESOLUTION NO. 66R-219
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM CONSENTING TO THE SUBORDINATION OF
CERTAIN EASEMENTS OF THE CITY TO A CERTAIN
EASEMENT OF THE METROPOLITAN WATER DISTRICT,
AND AUTHORIZING THE MAYOR AND CITY CLERK TO
SIGN A SUBORDINATION OF EASEMENTS AGREEMENT.

WHEREAS, Louis E. Nohl and Margaret Elliott Nohl did
heretofore grant certain easements to the City of Anahe~ over
certain real property in the County of Orange; and
WHEREAS; the Metropolitan Water District of Southern
California is acquiring an easement from the said Louis E. Nohl
and Margaret Elliott Nohl to construct, reconstruct, operate,
maintain and remove water mains, laterals, a meter vault and
the underground and aboveground appurtenances thereto, within
a portion of the real property affected by the above-mentioned
easements granted to the City of Anaheim, said portion being
more particularly described as follows:
Beginning at a point in that certain course having a
bearing and distance of South 190 13' 59" West 323.14
feet, in the center line description of the permanent
right of way, 50 feet wide., of the Metropolitan Water
District of Southern California, as described in deed
recorded August 18, 1955, in Book 3179, page 22, of
Official Records, in the office of the Recorder of said
County of Orange, said point being distant South 190 13' 59"
West along said certain course 187.74 feet from the angle
point at the northerly terminus thereof; thence North
700 46' 01" West at right angles to said certain course,
25.00 feet to the TRUE POINT OF BEGINNING in the Westerly
line of said permanent right of way, 50 'feet wide, said
last mentioned point being also the most northeasterly
corner of that certain permanent easement conveyed to

by deed recorded in Book 3407, page 16, in the office of
said Recorder; thence continuing North 700 46' 01" West
.along the northerly line of said last mentioned perma-
nent easement 35.00 feet; thence leaving said northerly
line North 190 13' 59" East along the northerly prolonga-
tion of the westerly line of said last mentioned permanent
easement 25.00 feet; thence South 700 46' 01" East 35.00
feet to a point in said westerly line of said first men-
tioned permanent easement, 50 feet wide; thence South
190 13' 59" West along said last mentioned westerly line
25.00 feet to said True Point of Beginning.
Containing 0.02 acre, more or less.
AND WHEREAS, the above described property will be used
by The Metropolitan Water District in the course of supplying
water to the City and comprise what is known as a "Service
Connection," and Metropolitan Water District has, therefore,
requested that its easement be paramount to the rights granted
to the City by the said Nohls; and

WHEREAS, the City Council does find that in considera-
tion of the construction and operation of said Service Connec-
tion by said Water District, and the fact that said property
will be used by said Water District in the course of supplying
water to the City, the above-mentioned easements of the City
should be ~ubordinate to the easement which said Water District
is acquiring.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that in consideration of the construction
and operation of said Service Connection by the Metropolitan
Water District, the City of Anaheim does hereby approve the
subordination of its above-mentioned easements to the easement
described above, which said Water District is acquiring, so as
to make said Water District's said easement, when obtained,
superior in every respect to the easements of the City, and
does hereby authorize the Mayor and City Clerk to execute a
Subordination _.of Easements Agreement in accordance with this
resolution.
THE FOREGOING RESOLUTION is approved and signed by
me this 22nd day of March, 1966.
