RESOLUTION NO. 66R-204
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING CONDITIONAL USE
PERMIT NO. 769
WHEREAS, the City Planning Commission of 'the City of
Anaheim did receive a request for a conditional use permit from
Grace Elizabeth Dickerson, c/o MacMahon, Nelson and Tilson,
1695 West Crescent Avenue, Anaheim, California, to establish
a one and two-story planned residential development of 42 units,
with a waiver of the maximum height limitation of any building
within 150 feet of a single-family residential zone (Section
l8.28.050(5-b) of the Anaheim Municipal Code), on the follow-
ing described property situated in the City of Anaheim, County
of Orange, State of California, to wit:
The West seven (7) acres of the North twenty (20) acres of
Lot ten (10) of Anaheim Extension in the City of Anaheim,
as shown on a map thereof made by William Hamel and filed in
the office of the County Recorder of Los Angeles County,
California;
EXCE~TING THEREFROM all that portion of said land lying
40 feet Northerly of the center line of East Broadway, as
shown on a map of Tract No. 1565, recorded in book 49, pages
19 through 24, inclusive, and Tract No. 1770, recorded in
book 59, pages 7 through 10, inclusive, Miscellaneous Maps,
records of said Orange County, as granted to the city of
Anaheim a municipal corporation, in deed recorded October
13, 1954, in book 2841, page 188, Official Records, in the
office of the County Recorder of said Orange County.
ALSO EXCEPTING the Northerly 180 feet.
AND WHEREAS, the City Planning Commission did hold a
public hear.iug at .the City Hall in the City of.. Anaheim upon
said request on oc~o,er 18 ,19 65 ; notices of which, said
pub1ic.hearing were u y given as required by law and the pro-
visions of Title 18, Chapter 18.76 of the Anaheim MUnicipal Code;
and
WHEREAS, said Commission, after due inspection, inves-
tigation and studies made by itself and in its behalf and after
due consideration of all evidence and reports offered at said
hearing, did adopt its Resolution No. 1817 -- Series 1965-66 ,

WHEREAS, thereafter; within twenty-two days from. the
date of. the adoption of sa~d resolution, the City Council did
elect, upon its own motion, to revieW the action of the City
Planning Commission in deQvin2 said. conditional use
permit and did thereupon fix' the i3rd . day of ~ovember
19 65 ,as the time and the Counc! Chamber in the ity Hall

of the City of Anaheim as the place for a public hearing upon
said Conditional Use Permit, and notices of such public hearing
were duly given as required by law and the provisions of Title
18, Chapter 18.76 of the Anaheim MUnicipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council does find after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said hearing,
that Conditional Use Permit No. 769 should be denied. .
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commis-
sion ~ Conditional Use Permit No. 769 be, and the
same ~sustained ,and that the request of Grace
Elizabeth Dickerson for a Conditional Use Permit to establish
a one and two-story planned residential development of 42 units,
with a waiver of the max~um height limitation of any building
within 150 feet of a single-story residential zone (Section
l8.28.050(5-b) of the Anaheim Municipal Code, on the property
hereinbefore described, be, and the same is hereby denieo.
