66-176 - RESOLUTION NO. 66R-176. A RESOLUTION OF THE CITY COUNCIL OF TIlE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 805. . WHEREAS, the City Planning Commission of the City of Anaheim dld receive an applica~ion for a conditional use permit from MOTEN M. DIZNEY and DOROTHY B. DIZNEY, husband and wife; MAUDE A. DIZNEY; ROBERT H. LINTZ and MARY A. LINTZ, husband and wife; and J. TYSON ELLIS and MARCIA M. ELLIS, husband and wife, to establish a planned residential development, with waivers of the following Anaheim Municipal Code requirements: 1. One-story maximum height limitation of buildings within 150 feet of R-A or R-l zoned property; 2. Accessory buildings (garages) abutting side property lines shall be located within the rear 25% of the build- ing site; 3. Living units shall be located within 200 feet of a standard street; 4. Minimum distances between buildings, on the following described property situated in ~he City of Anaheim, County of Orange, State of California, to wit:. PARCEL 1: The East 5 acres of the East 9 acres of the West 14 acres of the North half of the Northeast quarter of the Northwest quarter of Section 24, Township 4 South, Range 11 Hest, San Bernardino Base and Meridian, in the City of Anaheim, County of Orange, State of California. WHEREAS, at the time and place fixed for said public . hearing, the City Council did duly hold and conduct.such hear- ing &nd did give all persons 1nt~rested ther.ein an opportunity , to be heard and di~ receive evidence and repbrts; and WHEREAS, the City Council finds, after careful conside- ration. of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, .that: _. 1. " The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. NOWl) THER.EFORE, BE IT RESOLVED by tbe City Council of the City of Anaheim that tbe action of the City Planning Com- mission e:rantine: said Conditional Use PeriD.it be, and the same is hereby sustained, and that Conditional Use Permit No. 805 , be, and the same is hereby, granted permitting the establishment of a planned residential develo~ment~ and permitting waivers of the following Anahefm Munic1pa1 ~ode requirements: (1) .- (2) (3) s. (Section 18.28.050(S-b)); Accessory buildings (garages) abutting side property lines shall be located within the rear 25% of the building site (Section 18.28.050(6-c)); Living units' shall be located within 200 feet of a standard street (Section 18~28.050(9-b)); -2- - (4) Minimum distances between buildings (Section 18.28.050 (7-a)) , on the property hereinbefore described, subject to the follow- ing conditions: 1. That trash storage areas shall be provided in ac- cordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets. 2. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 3. That this Conditional Use Permit is granted subject to the ~ompletion of Reclassification Proceedings No. 65-66-82 now pending. 4. That a 6-foot masonry wall shall be constructed along the property lines where garages do not abut the property lines. . 5. That the proposed l5-foot one-way alley, extending southerly from the private drive, shall be increased to a 20-foot, two-way alley to provide adequate cir- culation. ..- 6. That all air conditioning facilities shall be properly shielded from view from abutting streets. 7. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1 through 10; PROVIDED, HOWEVER, that the plans shall be revised to include the reduction of any structure within 150 feet of R-l, One-Family Residential Zoned property to one-story in height. 8. That Conditions Nos. 1, 2, 4, 5 and 6 above-mentioned shall be complied with prior to final building in- spection. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owners, their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
