66-174 - RESOLUTION NO. 66R-174 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 1759. ,,-.. WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from SO-GO ENTERPRISESl INC., owner of certain real property situa- ted in the City o~ Anaheim, County of Orange, State of Cali- fornia, described as follows: PARCEL 1. That portion of the West 5.13 acres of the North half of the Northwest quarter of the Northeast quarter of Section 24, Township 4 South, Range 11 West, in the Rancho Los Coyotes, as shown on a Map recorded in Book 51, page 7 of Miscellaneous Maps, records of Orange County, California, described as follows: Beginning at a point in the West line of the Northeast quarter of said Section 24, said point being 328.90 feet South of the Northwest corner thereof; thence continuing South along the West line of said Northeast quarter 165.41 feet to the Northwest corner of land conveyed to Charles E. Mullins a single man, by deed recorded August 24, 1948, in Book l6~1, page 250 of Official Records; thence South 890 59' 11" East along the North line of said land con- veyed to Charles E. Mullins, a single man, 338.71 feet to the Northeast corner thereof; thence North 00 12' 35" East 165.46 feet to the Southeast corner of the land con- veyed to Fred. E. McMurray and wife, by deed recorded July 23, 1948, in Book 1674, page 81 of Official Records; thence North 890 59' 4211 West 338.71 feet along the South line of said McMurray land and the Westerly extension thereof to the point of beginning. Excepting therefrom that portion described as follows: Beginning at the point on the West line of said Northeast quarter distant Southerly 328.90 feet from the Northwest corner of said Northeast quarter; thence Easterly along the Northerly line of the land conveyed to Alfred J. Vincenz by deed recorded in Book 2440, page 420 of Official Records, records of said County, 138.71 feet; thence Southerly, parallel with said West line, 100.00 feet; thence Westerly, parallel with said Northerly line, 138.71 feet to said West line; thence Northerly, along said West line, 100.00 feet to the point of beginning. Parcel 2. That portion of the West 5.13 acres of the North half of the Northwest quarter of the Northeast quarter of Section 24, Township 4 South! Range. 11 West, in the Rancho Los Coyotes, as said Sect10n is shown on the Map recorded in Book 51, page 11 of Miscellaneous Maps, records of said County, described as follows: Beginning at the point on the West line of said Northeast quarter distant Southerly 328.90 feet from the Northwest corner of said Northeast quarter; thence Easterly, along the Northerly line of the land conveyed to Alfred J. Vincenz by deed recorded in Book 2440, page 420 of Offi- cial Records, records of said County, 138.11 feet; thence ~ -1- - Southerly, parallel with said West line, 100.00 feet; thence Westerly, parallel with said Northerly line, 138.71 feet to said West line; thence Northerly, along said West line, 100.00 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on January 31, 1966, notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 1929, Series 1965-66, denying Variance No. 1759; and WHEREAS, thereafter within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in denying said variance and did set a public hearing thereon to be held on the 1st day of March, 1966, at 7:00 o'clock P.M. in the City Hall in the City of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, the City Council does find that: 1. There is no substantial property right possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. NOW THEREFORE, BE IT RESOLVED by the City Council of the City 01 Anaheim that the action of the City Planning Com- mission denying Variance No. 1759 be, and the same is hereby sustained; and that the petition for a conditional zoning variance permitting waivers of the maximum building height limitation and min~ parking requirements on the property hereinbefore described, be, and the same is hereby oenied.
