66-440RESOLUTION NO. 66R 44o A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM COMPROMISING CERTAIN EMINENT DOMAIN LITIGATION WITH THE CITY OF GARDEN GROVE AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A GRANT DEED IN FAVOR OF THE CITY OF GARDEN GROVE IN CONNECTION THEREWITH. WHEREAS, the City of Anaheim is the owner in fee of a certain parcel of land within the City limits of the City of Garden Grove described as follows: That portion of Lot 2, Tract No. 988 as shown on Map recorded in Book 32, page 50 of Miscellaneous Maps in the Office of the Recorder of the County of Orange, within the following described boundaries: Beginning at the most southerly corner of said lot; thence northerly along the easterly line of said lot a distance of 66.00 feet; thence westerly at right angles to said easterly line 87.08 feet to the southwesterly line of said lot; thence southeasterly along said southwesterly line 109.27 feet to the point of beginning. AND WHEREAS, the City of Garden Grove, in its eminent domain action, being Orange County Superior Court Case No. 145276, entitled "City of Garden Grove, etc., et al. v. Dorothy Knapp Yancey, et al.," seeks to condemn said parcel of land for public street purposes; and WHEREAS, the appraised value of said parcel of land as deposited in the Superior Court by the City of Garden Grove to justify its taking of immediate possession thereof, is, in the opinion of the City Council of the City of Anaheim, the fair and reasonable value of said land; and WHEREAS, the City of Garden Grove has offered to settle the aforementioned eminent domain litigation as far as the City of Anaheim is concerned by paying to the City of Anaheim the full amount deposited for said parcel, to wit: the sum of $2,700.00; and WHEREAS, the City Council finds that it is in the best interests of the City of Anaheim to accept said offer of compromise and in connection therewith to deed to the City of Garden Grove the hereinabove described property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that it compromise, and it does hereby compromise the eminent domain litigation hereinabove set forth for the cash consideration of $2,700.00. AND BE IT FURTHER RESOLVED that the Mayor and the City Clerk be, and they are hereby, authorized and directed to execute a grant deed to the hereinabove described property in favor of the City of Garden Grove, and that the same be delivered to the office of the City Attorney for transmittal to the City of Garden Grove.
