66-397AND WHEREAS, the City public hearing at the City Hall petition on March 28 1966 public hearing was duly given as sions of Title 18, Chapter 18.76 and 1965 -66 denied RESOLUTION NO, 66R -397 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE N0. 1774 f WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from GULF OIL CORPORATION owner of certain real property situated in the. City of Anaheim, County of Orange, State of California, described as follows';' That portion of Lot 15, Block K of the Kraemer Tract as shown on map recorded in Book 12, pages 87 and 88 of Miscel- laneous Records of Los Angeles County, State of California, in the City of Anaheim, County of Orange, State of California, described as follows: COMMENCING at the intersection of the centerline of Dowling Avenue (83.00 feet in width) with the centerline of La Palma Avenue (83.00 feet in width); thence North 73° 04' 36" East, along the centerline of La Palma Avenue, 203.00 feet; thence North 16° 55' 54" West 53.00 feet to a point on the north- westerly line of said avenue, said point being 53.00 feet measured northwesterly at right angles to said centerline, said point also being the TRUE POINT OF BEGINNING of this description; thence North 16° 55' 54" West, parallel to the centerline of Dowling Avenue, 150.00 feet; thence South 73° 04' 36" West 150.00 feet to a point on the proposed north- easterly line of Dowling Avenue, said point being 53.00 feet measured northeasterly at right angles to the center line of Dowling Avenue; thence South 16° 55' 54" East, parallel to said centerline, 125.00 feet to the point of tangency of a curve concave to the northeast, having a radius of 25.00 feet and a central angle of 89° 00' 30 thence southeasterly along said curve 39.84 feet to a point of tan- gency on the northwesterly line of La Palma Avenue; thence North 73° 04' 36" East along said northwesterly line 125.00 feet to the. Planning Commission did hold a in the City of Anaheim upon said notice of which said required by law and the provi- of the Anaheim Municipal Code; WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 1986 Series recommending that Variance No. 1774 be ;and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission denying said variance, and said appeal was set for public hearing on May_ 10th 19 66 at 7:00 o'clock P.M. at the City 1411 in City of Anaheim, and notice of such public hearing ►as duly given as required by law and the provisions of Title 18, Chapter 183.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preserva- tion and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. y,. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting waivers of the following Anaheim Municipal Code limitations and requirements, on the property here inbefore described, subject to the conditions hereinafter set forth: 1. A waiver of the maximum height of a free- standing sign (Section 18.62.090 (b -2 and 3)). 2. A waiver (Section 3. A waiver (Section 4. That said variance is granted subject to the following conditions: 1. That subject property shall be developed sub- stantially in accordance with plans and specifi- cations on file with the City of Anaheim, marked Exhibits Nos. 1, 2 and 3. 3. That the proposed sign shall be no higher than the highest existing oil company sign at the intersection of La Palma Avenue and Dowling Street. 4. That the proposed sign shall have a maximum area of 300 square feet. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, its successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is signed and approved by me this 8th day of June, 1966.
