66-389AREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 65 66 114 to consider an amendment to Title 18 t7 Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 31st day of May 19 66 as the time, and the City Council Chambers in the City r of the City of Anaheim as the place for public hearing upon said proposed amendment to Title 18 of the Anaheim Municipa1 Code, =.nd the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the sum, +,ary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: RESOLUTION NO.66R -389 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM F1PDING AND DETERMINING THAT 'IITT E 18 OF THE ANAHEIM MUNICIPAL CODE RELATINC TO ZONING SHOULD BE AMENDED AND THA/ B E BOUNDARIES OF CERTAIN Z C V E S SHOULD B. CHANGED. PARCEL 1: That portion of the East 1/2 of the fractional Northwest 1/4 of Section 3, Township 4 South, Range 10 West, described as follows: Beginning at a point in the North line of said Northwest 1/4, 962,66 feet West of the Northeast corner thereof; running thence South parallel to the East line of said Northwest 1/4, 913 feet; thence West parallel to the North line of said Northwest 1/4, 367.10 feet to a point in the West line of the East 1/2 of said Northwest 1/4, said point being in the center line of Lemon Street; thence North along said West line 913 feet to the Northwest corner of the East 1/2 of said Northwest 1/4; thence East along the North line of said Northwest 1/4, 366.24 feet to the point of beginning, containing 7.685 acres. EXCEPTING THEREFROM the West 228.00 feet of the North 253 feet of the Northeast quarter of the Northwest quarter of Section 3, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, partly in the City of Anaheim, partly in the City of Fullerton, all in the County of Orange, State of California, as per map recorded in Book 51, page 10 of Miscellaneous Maps, in the Office of the County Recorder of said County. PARCEL 2: The West 1/2 of the following: Beginning at a point 481.33 feet West of the Northeast corner of the Northwest 1/4 of Section 3, Township 4 South, Range 10 West; thence South parallel to the East line of said Northwest 1/4, 905 feet; thence West parallel to the North line of said Northwest 1/4, 481.33 feet thence North parallel to the East line of said Northwest 1/4, 905 feet to the North line of the said Northwest 1/4; thence East along the North line of said Northwest 1/4, 481.33 feet to the point of beginning. be excluded from M -1, LIGHT INDUSTRIAL ZONE and P -L, PARKING LANDSCAPING ZONE, and incorporated in C -2, GENERAL COMMERCIAL ZONE, upon the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street along Lemon Street, for street widening purposes, EXCEPT THAT along the northern 175 feet of subject property said strip of land shall vary from 45 feet to 47 feet in width, and said dedication shall include a 15 -foot radius corner return at Durst Street. 2. (a) That all engineering requirements of the City of Anaheim along Lemon Street, including prepara- tion of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 3. -That all vehicular access rights to Durst Street shall be dedicated to the City of Anaheim. 4. That the owner of subject property shall pay to the City of Anaheim the sum of 15¢ per front foot, along Lemon Street and Orangethorpe Avenue, for tree planting purposes. 5. That sidewalks shall be installed along Orangethorpe Avenue, as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer, prior to final building inspection. 6. That all air conditioning facilities shall be properly shielded from view from abutting streets. 7. That subject property shall be developed in accord- ance with the Site Development Standards of the C -1, General Commercial Zone; and that the required interior landscaped area shall be planted with trees in order to be in conformity with the existing industrial and commercial development in the area. 8. That Conditions Nos. 1, 2(b), 3 and 4 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to-prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determi ed to be necessary and proper.
