A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AMENDING RESOLUTION NO.
65R -799 IN RECLASSIFICATION PROCEEDINGS
NO. 61- 62 -92.
WHEREAS, the City Council did heretofore, to wit, on
November 2, 1965, adopt Resolution No. 65R -799 amending Resolu-
tion No. 62R -446 in Reclassification Proceedings No. 61 -62 -92
by changing the proposed reclassification of certain portions
of the property described in said proceedings, by deleting all
conditions contained in said Resolution No. 62R -446, and by
substituting therefor certain other conditions; and
WHEREAS, Condition No. 4 -(a) of Resolution No. 65R -799
reads as follows:
"(a) That a final tract map of subject property
shall be submitted to the City Council for
approval and recorded in the Office of the
County Recorder of Orange County."
AND WHEREAS, since the adoption of said Resolution No.
65R -799, Variance No. 1794 has been granted permitting the
development of the R -3 property, described in said reclassifica-
tion proceedings, as a single lot under the R -3 Zone standards;
and
WHEREAS, the City Council does, therefore, find that
Condition No. 4 -(a) should be deleted from Resolution No.
65R -799; and
WHEREAS, Condition No. 4 -(b) of said Resolution No.
65R -799 provides that the owners of subject property shall pay
to the City of Anaheim the sum of 15¢ per front foot along
certain streets and parcels for tree planting purposes, said
amount to be collected as a portion of the subdivision fees;
and
WHEREAS, the City Council finds that, in view of the
fact that the property is not to be subdivided and no sub
division fees will, therefore, be collected, Condition No. 4 -(b)
should be amended to provide that the sum of 15¢ per front foot
for tree planting purposes be paid prior to the adoption of the
ordinance reclassifying subject property; and
WHEREAS, the City Council does further find that an
ordinance has never been adopted directing said change of zones
and completing said reclassification proceedings.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that Resolution No. 65R -799 in Reclassi-
fication Proceedings No. 61 -62 -92 be, and the same is hereby,
amended as follows:

BE IT FURTHER RESOLVED that in all other respects
said Resolution No. 65R -799 be, and remain, in full force and
effect.
THE FOREGOING RESOLUTION is approved and signed by me
this 31st day of May, 1966.
ATTEST:
1. That Condition No. 4 -(a) be, and the same is
hereby, deleted.
2. That Condition No. 4 -(b) be, and the same is
hereby, amended to read as follows:
"(b) That the owners of subject property shall pay
to the City of Anaheim the sum of 150 per
front foot along Lincoln Avenue and Gilbert
Street, for Parcels 1 and 2, for tree planting
purposes, said amount to be paid prior to the
adoption of an ordinance reclassifying subject
property."
