66-306RESOLUTION NO. 66R -306 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 65 66 94 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 26th day of April 19 66 as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 65 -66 -94 The northerly 150.00 feet of the southerly 190.00 feet of the westerly 203.00 feet of section 7, Township 4 South, Range 10 West, in the Rancho Los Coyotes, city of Anaheim, county of Orange, state of California, as per map recorded in book 51 page 10 of Miscellaneous Maps, in the office of the county recorder of said county. EXCEPT that portion thereof described as follows: Beginning at the intersection of the northerly line of the southerly 40.00 feet of said section with the east- erly line of the westerly 40.00 feet of said section; thence westerly 40.00 feet to the westerly line of said section; thence northerly 10.00 feet along last said westerly line to the northerly line of the southerly 50.00 feet of said section; thence easterly 30.00 feet along last said parallel line; thence southeasterly in a direct line to the point of beginning. Said land is included within the area shown on a map filed in book 7 page 49 of Record of Surveys, in the office of said county recorder. be excluded from R -A, AGRICULTURAL ZONE, and incorporated in C -1, GENERAL COMMERCIAL ZONE, upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width from the center line of the street, along Magnolia Avenue, for street widening purposes, including a 25 -foot radius corner return. 2. (a) That all engineering requirements of the City of Anaheim along Magnolia Avenue and Lincoln Avenue, including preparation of improvement plans and instal- lation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifica- tions on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfac- tory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 3. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Magnolia and Lincoln Avenues, for street lighting purposes. 4. That the owners of subject property shall pay to the City of Anaheim the sum of 15C per front foot along Magnolia and Lincoln Avenues, for tree planting purposes. 5. That trash storage areas shall be provided in accord- ance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 6. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building inspection. -2- ATTEST: 7. That any air conditioning facilities shall be properly shielded from view from abutting streets. 8. That subject property shall be developed substan- tially in accordance with City of Anaheim Service Station Minimum Site Development Standards. 9. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1, 2 and 3, and the colored rendering submitted by the petitioners and on file with the City. 10. That Conditions Nos. 1, 2(b), 3 and 4 above- mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and sub- mit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
