66-293RESOLUTION NO. 66R- 293 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING AND DIRECTING THE COM- PROMISE OF CERTAIN EMINENT DOMAIN LITIGATION, AND DIRECTING THE DIRECTOR OF FINANCE TO MAKE CERTAIN PAYMENTS IN CONNECTION THEREWITH. WHEREAS, heretofore, by its resolution duly adopted and passed on the 20th day of January, 1966, the City of Anaheim authorized and directed the institution of condemnation proceed- ings which resulted in the commencement of Orange County Superior Court Case No. 144895, being entitled "City of Anaheim vs. Joseph D. Huarte, et ux., et al. and WHEREAS, Defendant, The Heirs and Devisees of Alice E. Brady as to a portion of Parcel 2 and their successors in interest as to the remainder of Parcel 2, have offered to settle the foregoing litigation (as to Parcel 2) for the total cash consideration and in the manner hereinafter set forth; and WHEREAS, as to City Council of the City $27,720.00 (being at the and reasonable amount to the 0.924 acres of said Parcel 2, the of Anaheim finds that the sum of rate of $30,000.00 per acre) is a fair be paid for said portion; and WHEREAS, as to the remaining 3.947 acres of said Parcel 2, the City Council of the City of Anaheim finds as follows: that the sum of $106,569.00 to be paid forthwith (being at the rate of $27,000.00 per acre) and special damages in the amount of $14,978.64 to be paid upon the filing of a final map on Tract 6138 and the deposit of appropriate bonds for the improve- ments of said tract, are fair and reasonable amounts to be paid for said land. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Anaheim that the Director of Finance be, and he is hereby authorized and directed to deliver to the City Attor- ney's Office the sum of $27,720.00, payable to Estate of Alice E. Brady to be delivered to said Defendant, Estate of Alice E. Brady; AND BE IT FURTHER RESOLVED that the Director of Finance be and he is hereby authorized and directed to deliver to the City Attorney's Office the sum of $106,569.00, payable to Macobe, Inc., to be delivered by the City Attorney forthwith, and to deliver to the City Attorney's Office the sum of $14,978.64 payable to Macobe, Inc., to be delivered when the Final Map on Tract No. 6138 has been approved and filed and appropriate bonds (in the opinion of the City Attorney) for the improvements of said tract have been deposited.
