66-235WHEREAS, heretofore, by its resolution duly adopted
and passed on the 14th day of April, 1964, the City of Anaheim
authorized and directed the initiation of condemnation proceed-
ings which resulted in the commencement of Orange County Superior
Court Case No. 123305, being entitled "City of Anaheim vs. Aeroc,
Inc. etc., et al. and
WHEREAS, Defendants, Hugh F. Colvin and Audy Lou
Colvin, have offered to compromise said litigation and have
heretofore filed with said Superior.Court a stipulation settling
a portion thereof and are now willing to completely settle said
litigation for a total cash consideration of $266,522.50 (being
payment for 7.8930 net acres $32,500 per acre, and the sum
of $10,000 in consideration of waiving all defenses); and
WHEREAS, the City Council of the City of Anaheim finds
that the sum of $266,522.50 is a fair and reasonable amount to
be paid for the property condemned.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the Director of Finance be, and he is,
hereby authorized and directed to deliver to the City Attorney's
Office the sum of $266,522.50, payable to Hugh F. Colvin and
Audy Lou Colvin, to be delivered by the City Attorney forthwith.
AND BE IT FURTHER RESOLVED that the City Attorney be,
and he is, hereby authorized and directed to take immediate
steps toward the entry of a Final Order of Condemnation in con-
nection with the foregoing.
THE FOREGOING RESOLUTION is approved and signed by me
this 29th day of March, 1966.
