66-660RESOLUTION NO. 66R -660 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 182 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for Soning variance from Doroth A. Lestmann and Henr E. Lestmann o o cer a n rea proper y s ua ed m e ty o na e m, ounty of Orange, State of California, described as follows: The North 257 feet of the East 316.50 feet of the northeast one- quarter of the south- east one- quarter of the Section 13, Township 4 South, Range 11 West in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as per map recorded in Book 51, page 11 of Miscellaneous Maps, in the office of the County Recorder of said Orange County. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on Septenher 12 9 19 s notice of which said public hearing was duly given as req r d by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission after due inspection, investigation_and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. =ffSIMPIAPP PC66 -77 denying Variance No. 1824 and WHEREAS, thereafter within twenty..two(22) -days from the date of the adoption of said resolution, the. City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in de ying said variance and did set a publi,c..,hearing thereon to be held on the llth day of Octob 1966 at 7:00 o!clock P.M. in the City Hall in the y ©f Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18,_,Chapter 18.76 of the Anaheim Municipal Code; and THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission WHEREAS, the City Council does find that: 1. There is no. substantial property right,,,possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. -1- denying Variance No. 1824 be, and the same is hereby sustained, and that the petition of Dorothy A. Lestmann and Henry E. Lestmann for a zoning variance permitting a waiver of the minimum front yard building setback area (Section 18.40.070(2 -a -1) of the Anaheim Municipal Code) and a waiver of the formula governing height limitation of structures within 150 feet of a single- family residential zone (Section 18.40.070(3 -a) of the. Anaheim Municipal Code, on the property hereinbefore described, be, and the same is hereby denied. THE FOREGOING RESOLUTION is approved and signed by me this llth day of October, 1966.
