66-649RESOLUTION NO. 66R -649 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 873 WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a conditional use permit from Doyle Shields Realty Co., Inc., 1333 South Euclid Street, Anaheim, California, to establish a cocktail lounge in a commercial shopping center, with waivers of the Anaheim Municipal Code limitations as to the number and location of free standing signs, on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: Lot 16 of Tract No. 2534, in the City of Anaheim, County of Orange, State of California, as per map recorded in book 115, pages 15 and 16 of Miscellaneous Maps, in the office of the County Recorder of said County. EXCEPT the North 130.00 feet thereof. ALSO EXCEPT that portion thereof lying South of a line that is parallel with and 200.00 feet northerly, measured at right angles from the center line of Ball Road as said center line is shown on said map. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of. Anaheim upon said request on August 9 19 66 notices of which said public hearing were du given as required by law and the pro- visions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its ResolutionsNos. PC65 58 and PC66 85 granting Conditional Use Permit No. 873. in part, subiec to the conditions tt rein spt forth and WHEREAS, thereafter, within twenty -two days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in granting said conditional use permit and did thereupon fix the 1 da of October 19 66 as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for public hearing upon said conditional use permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipa1 Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 873 should be denied. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion gr4nting Conditional Use Permit No. 873 be, and the same is hereby disapproved and that the request of Doyle Shields Realty Co., Inc., for a conditional use permit to establish a cocktail lounge in a commercial shopping center, with waivers of the Anaheim Municipal Code limitations as to the number and location of free standing signs on the property hereinbefore described, be, and the same is hereby denied.
