66-633RESOLUTION NO. 66R 633 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 1819 WHEREAS, the City Planning- ommission of the City of Anaheim did receive a petition for Zoning variance from s_ANK NULLER nd 11 WA o certain rea proper y s ua ed m e ty o na e m, ounty of Orange, State of California, described as follows: The North 320.00 feet of the East 122.00 feet of the Northeast quarter of the Northeast quarter of the Northwest quarter of Section 17, Township 4 South, Range 10 West, in the Rancho Los Coyotes, as shown on a map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California. EXCEPTING THEREFROM the North 66.00 feet as described in a deed to the State of California, recorded January 15, 1958 in Book 4163, page 589 of Official Records. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on .i]siust 19 9 1 9 6 notice of which said public hearing was duly given as requ by law and the provisions of.Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission after due inspection, investigation_and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. w_a4 44s= PC66 49 denying. Variance No. 1819 and WHEREAS, thereafter within twentymtwo:(22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in d nv ngg said variance and did' set a pubsic thereon to be held on the 27t day of s ber 1966 at 7:00 o!clock P.M. in the CityHaal1 in the o Anahe and notice of such public hearing was duly given as required by law and the provisions of Title 18,_Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, the City Council does find that. 1. There s.no substantial property right„ by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission -1 denying Variance No. 1819 be, and the same is hereby sustained, and that the petition of Frank Muller and Mrs. Walter Muller for a zoning variance permitting a waiver of the maximum height limitation of any building or structure within 300 feet of any single family residential zone boundary (Section 18.38.050(3 -A) of the Anaheim Municipal Code), on the property hereinbefore described, be, and the same is hereby denied.
