66-627RESOLUTION NO. 66R- 627 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DESCRIBING THE STATUS OF THE NECESSARY RIGHT OF WAY IN CONNECTION WITH THE KATELLA AVENUE RAILROAD UNDER- PASS. WHEREAS, in connection with the operation of the Anaheim Stadium and the rapid growth of the southeastern area of the City, it has become necessary to improve Katella Avenue by developing an underpass where Katella Avenue inter- sects with the Atchison, Topeka and Santa Fe Railroad; and WHEREAS, the City Council has heretofore passed its resolution determining the necessity for and directing the acquisition by eminent domain of certain real property in connection with such development; and WHEREAS, except for the legal formalities, said project is ready to proceed; and WHEREAS, the State of California Department of Public Works, Division of Highways, has requested certified copies of a resolution describing the status of the necessary right of way in connection with said project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it does herewith set forth the status of the necessary right of way in connection with the under- crossing of Katella Avenue at its intersection with the Atchison Topeka and Santa Fe as follows: 1. The total number of parcels to be acquired by the City is five and in addition thereto, one parcel for temporary easement purposes during construction. 2. No parcels have as yet been acquired but four of the five permanent parcels have been included in a resolution determining the necessity of acquisition by eminent domain. 3. The number of parcels for which orders of im- mediate possession or rights of way have been obtained is none; however, this can and will be accomplished within the twenty -one days statu- tory period immediately following eminent domain action. (This applies to all parcels involved including the one necessary for the temporary access.) 4. The action taken to insure that the right of way will be clear in sufficient time to award a con- struction contract within the required six months has been taken in the resolution determining necessity (heretofore referred to); and, in addi- tion thereto, a timely action in eminent domain will be filed and will result in the immediate possession desired. BE IT FURTHER RESOLVED that a certified copy of this resolution be forwarded by the City Clerk to the State of California Department of Public Works, Division of Highways, through the Director of Public Works of the City of Anaheim.
