A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING CONDITIONAL USE
PERMIT NO. 871
WHEREAS, the City Planning Commission of the City of
Anaheim did receive a request for a conditional use permit from
Giacomo Lugaro and Agostina Lugaro, 420 North Magnolia Avenue,
Anaheim, California, to permit on -sale beer in a neighborhood
shopping facility on the following described property situated
in the City of Anaheim, County of Orange, State of California,
to wit:
The West 275.53 feet of the Northwest
quarter of the Southwest quarter of
Section 7, Township 4 South, Range 10 West,
San Bernardino Base and Meridian, in the
City of Anaheim, County of Orange, State
of California.
EXCEPTING THEREFROM any portion on the South
as conveyed to the City of Anaheim, by deed
recorded October 14, 1960, in Book 5436,
Page 528 of Official Records.
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said request on August 15' 19 66 notices of which said
public hearing were duly given as Wit by law and the pro-
visions of Title 18, Chapter 18.76 of the Anaheim Municipal Code;
and
WHEREAS, said Commission, after due inspection, inves-
tigation and studies made by itself and in its behalf and after
due consideration of all evidence and reports offered at said
hearing, did adopt its Resolution No. Pr 46 47
deriving Conditional Use Permit No. 871
and
WHEREAS, thereafter, within twenty -two days from the
date of the adoption of said resolution, the City Council did
elect, upon its own motion, to review the action of the City
Planning Commission in deAyino said conditional use
permit and did thereupon fix the 27th day of Septemb r
19 66 as the time and the Council Chamber in the City Hall
of the City of Anaheim as the place for a public hearing upon
said conditional use permit, and notices of such public hearing
were duly given as required by law and the provisions of Title
18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council does
consideration of the recommendations of
Commission and all evidence and reports
that Conditional Use Permit No. 871
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commis-
sion denying Conditional Use. Permit No. R71 be, and the
same is hereby sustained and that the request of
Giacomo Lugaro and Agostina Lugaro for a conditional use permit
to allow on -sale beer in a_ neighborhood shopping facility on
the property hereinbefore described, be, and the same is hereby
denied.
THE FOREGOING RESOLUTION' is approved and signed by me
this 27th day of September 19 66
