A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING AN AGREEMENT
OF RENEWAL WITH HOBBS TRUCKING COMPANY.
WHEREAS, the City of Anaheim and Hobbs Trucking
Company did enter into a lease for a term of five years com-
mencing on the 1st day of September, 1961 and ending on the
31st day of August, 1966, wherein the City did lease to
Hobbs Trucking Company certain real property situated in the
County of Orange, State of California, and described as:
a portion of the West half of the southeast quarter of Section
3, Township 4 South, Range 10 West, and more particularly
described in the aforementioned lease between the parties;
and
WHEREAS, under the terms of said lease, Hobbs
Trucking Company, Lessee, was given the option to lease the
demised premises for an additional five -year period upon the
expiration of the term of said lease upon giving written notice
of intent to exercise the option not less than ninety (90)
days prior to the expiration of the lease. All terms of the
lease were to be the same upon exercise of the option, except
that the City of Anaheim, Lessor, during the extended period
of the lease would have the privilege of termination of said
lease upon giving the Lessee one (1) year's notice of intent
to terminate the lease upon a finding by the City Council of
the Lessor "that the demised premises are necessary for use
by the Lessor and
WHEREAS, Hobbs Trucking Company, Lessee, did express
its written intention to exercise the option but failed to
give such notice ninety (90) days prior to the expiration of
the term of the lease; and
WHEREAS, the City of Anaheim is willing to extend
the term of the lease for an additional five (5) years on the
same basic terms and conditions with a minor modification
rather than to cancel the extended term for failure of the
Lessee to strictly comply with the terms of the exercise of
option; and
WHEREAS, the Lessee is willing to enter into the
minor modification with Lessor.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the Indenture of Lease entered
into by and between the City of Anaheim, as Lessor, and Hobbs
Trucking Company, as Lessee, as of the 1st day of September,
1961, be renewed and extended for an additional term of five
(5) years, commencing on the 1st day of September, 1966 and
ending on the 31st day of August, 1971, on the same terms and
conditions as contained in said lease under date of September
1, 1961, except that during the term of said extension the
City shall have the right to cancel such lease at any time,
provided the City shall have given notice of its intention
to terminate said lease, not less than one year prior to the
date selected by it for the termination of said lease; and
provided further that the City shall terminate said lease only
upon a finding by the City Council that the demised premises
are necessary for use by the City, or upon a finding by the
City Council that the premises are no longer needed for City
purposes and the sale of said premises would be in the best
interests of the City.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby authorized to execute such renewal of
lease for and on behalf of the City of Anaheim.
The FOREGOING RESOLUTION is approved and signed by
me this 26th day of July, 1966.
