A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE EXECUTION
OF AN AGREEMENT BETWEEN THE CITY OF ANAHEIM
AND THE CITY OF GARDEN GROVE, WITH REFERENCE
TO THE SALE OF WATER TO THE CITY OF GARDEN
GROVE.
WHEREAS, the City of Garden Grove has a shortage of
domestic water because a number of its wells have been shut
down due to nitrate contamination; and
WHEREAS, the City of Garden Grove's well production
has been reduced to approximately 5,000 gallons per minute
because of the contamination of said wells; and
WHEREAS, the City of Garden Grove has insufficient
facilities remaining to supply the needs of the City with
water; and
WHEREAS, said City of Garden Grove is in the process
of planning extensive capital improvements needed to develop
adequate water storage; and
WHEREAS, the emergency shortage of water in the
City of Garden Grove is temporary in nature because of the
action proposed by said City to alleviate the water shortage;
and
WHEREAS, the City of Garden Grove has requested the
City of Anaheim to provide water through emergency connections
to the City of Garden Grove under letter dated May 26, 1966
and signed by its Director of Public Works; and
WHEREAS, the Cities of Anaheim and Garden Grove
believe that the sale of water through said emergency connections
is to the benefit of the citizens of both communities.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that an agreement be made and entered
into by and between the parties, providing for the sale and
purchase of water upon the following terms and conditions:
1. The City of Anaheim shall agree to sell to the
City of Garden Grove and said City of Garden Grove
shall agree to purchase and take from the City of
Anaheim a supply of water through six -inch
emergency connections located at the three follow-
ing locations:
A. Katella and Easy Way
B. Orangewood and Euclid
C. Katella west of Varna

2. The City of Garden Grove shall agree to pay for
the water furnished by the City of Anaheim, through
the connections hereinbefore mentioned, the
Metropolitan Water District rate for softened and
filtered water, plus ten per cent of said rate, in
effect at the time the water, is delivered by
Anaheim to Garden Grove.
The City of Garden Grove shall bear all cost of
construction of the emergency connections. Said
City of Garden Grove shall also agree that it will
,install and bear the cost of installation of suitable
regulating devices in order to properly protect
Anaheim's water system.
4. The City of Anaheim shall reserve the right to
terminate or curtail prior to the expiration of the
term of said agreement the amount of water delivered
through the emergency connections because of (1) a
water shortage, (2) unsuitable effects upon the City
of Anaheim's water distribution system, or (3) for
such other good reason as the Utilities Director of
the City of Anaheim may in his absolute discretion
determine.
5. The City of Garden Grove shall agree that the water
to be provided through the emergency connections
provided for in said agreement will not be used for
fire fighting.
6. The term of said agreement shall be six months from
the date of execution thereof.
7. At the conclusion of the term of said agreement or
in the event that the agreement is terminated prior
to the expiration of the term, the City of Garden
Grove shall agree to remove all emergency connections
and other devices which it constructs pursuant to
said agreement and to bear the cost of such removal.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are, hereby authorized to execute such agreement
for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
