A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM AUTHORIZING THE GRANTING
OF AN EASEMENT TO SOUTHERN CALIFORNIA
EDISON COMPANY FOR ELECTRICAL DISTRIBUTION
FACILITIES; AND AUTHORIZING THE EXECUTION
OF SAID GRANT OF EASEMENT.
WHEREAS, the Southern California Edison Company has
requested authority for the right to construct, lay, install,
use, maintain, alter, add to, repair, replace, inspect and /or
remove, at any time and from time to time, aerial and under-
ground electric lines and communication lines, consisting of
poles, guys and anchors, crossarms, wires, cables, conduits,
manholes, vaults, pull boxes, markers and other fixtures and
appliances for conveying electric energy to be used for light,
heat, power, telephone and /or other related uses, in, on, over,
under and through the real property hereinafter described; and
WHEREAS, the City Council finds that the granting of
such right or easement in, on, over, under and through the
hereinafter described property for the purposes above set forth
will not interfere with any other contemplated public use of
said property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that there be, and there is hereby, granted
to Southern California Edison Company, a corporation, its succes-
sors and assigns, an easement and right of way to construct, lay,
install, use, maintain, alter, add to, repair, replace, inspect
and /or remove, at any time and from time to time, aerial and
underground electric lines and communication lines, consisting
of poles, guys and anchors, crossarms, wires, cables, conduits,
manholes, vaults, pull boxes, markers and other fixtures and
appliances, for conveying electric energy to be used for light,
heat, power, telephone and /or other related uses, in, on, over,
under and through that certain real property in the County of
Orange, State of California, described as follows:
The west 4 feet of the north 348 feet of the
East half of the Northeast quarter of the North-
west quarter of Section 27, Township 4 South,
Range 10 West, in the Rancho San Juan Cajon de
Santa Ana, as shown on a map recorded in Book
51, page 10 of Miscellaneous Maps, in the Office
of the Recorder of said County.
ALSO the east 6 feet of the north 348 feet of
the West half of the Northeast quarter of the
Northwest quarter of said above mentioned
Section 27.
EXCEPTING THEREFROM said west 4 feet and said
east 6 feet of that portion lying within
Katella Avenue as now established.
BE IT FURTHER RESOLVED that the Southern California
Edison Company, its successors and assigns, and its and their
respective contractors, agents and employees, shall have the
right to trim or top such trees and to cut such roots as may
endanger or interfere with said electric lines and /or communi-
cation lines.and shall have free access to said electric lines
and communication lines and every part thereof, at all times, for
the purpose of exercising the rights herein granted, provided,
however, that in making any excavation on said property of
the City, Southern California Edison Company shall make the
same in such a manner as will cause the least injury to the sur-
face of the ground around such excavation, and shall replace the
earth so removed by it and restore the surface of the ground
to as near the same condition as it was prior to such excava-
tion as is possible.
BE IT FURTHER RESOLVED that the Mayor and the City
Clerk be, and they are hereby, authorized to execute a Grant
of Easement to carry out the purposes of this resolution and
to complete the granting of said easement to the Southern
California Edison Company.
THE FOREGOING RESOLUTION is approved and signed by
me this 5th day of July 1966.
