66-807RESOLUTION NO0.66R -807 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 1840 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from M,& S DEVELOPMENT COMPANY owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows That portion of the Northwest quarter of the Southeast quarter of Section 22, in Township 4 South, Range 10 West, San Bernardino Base and Meridian, in the City of Anaheim, County of Orange, State of California, described as follows: Beginning at a point in the West line of the Southeast quarter of said Section 22, said point being located 639.26 feet South 0 14' 30" East from the center of said Section 22, said center point being the inter- section of the center line of Cerritos Avenue from the West with the North and South quarter section line of said Section 22; thence North 89° 55' 30" East 660.75 feet to a 1 inch iron pipe; as shown on a Map of survey recorded in Book 15, page 4, Record of Surveys, in the office of the County Recorder of said Orange County; thence South 0° 14' 45" East 165.00 feet along the Southerly extension of and the East line of the North- west quarter of the Northwest quarter of the Southeast quarter of said Section 22; thence South 89° 55' 30" West 660.77 feet to a point in the said West line of the Southeast quarter of Section 22; thence North 0 -14' 30" West 165.00 feet to the point of beginning; EXCEPTING THEREFROM the North 75 feet. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on November 7 1966 notice of which said public hearing was duly given as required by law and the provi- sions of Title 18, Chapter 18076 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution NoopC66 -141 s4m4ss recommending that Variance No, 1840 be denied ;and -1 WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council of the City of Anaheim protesting the action of the City Planning Commission .._-.-Y;ng said variance, and said appeal was set for public hearing on eceipber 20 19 66 at 7 :00 o'clock P.M. at the City in the City of Anaheim, and notice of such public hearing lees duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 2. That such a variance is necessary for the preserva- tion and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and one in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same IS hereby granted permitting a reader panel, not to exceed 4 feet by 8 feet, to be attached to the extensions of the existing sign located on the property hereinbefore described, the lower portion of the reader board to be not less than 8 feet above the ground level. 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, its successors or assigns, to comply with the Anaheim Municipal Code and regulations herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
