66-724ATTEST: RESOLUTION NO. 66R- 724 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE EXECUTION OF A COOPERATIVE AGREEMENT WITH ORANGE COUNTY FLOOD CONTROL DISTRICT WITH REFERENCE TO CONSTRUCTION OF THE SOUTHEAST ANAHEIM CHANNEL AND THE KATELLA AVENUE UNDERPASS. WHEREAS, under authority of the Orange County Flood Control Act, the Orange County Flood Control District proposes to construct a portion of its Southeast Anaheim Channel, project E12, from Katella Avenue northerly through Howell Street; and WHEREAS, said Flood Control District's proposed con- struction will require the relocation of a City -owned 10 -inch cast -iron water line in the north side of Howell Street by the City's forces. Orange County Flood Control District would normally reimburse the City for its relocation costs due to the City's prior rights; and WHEREAS, the City's proposed construction of Katella Avenue undercrossing at the railroad will require the construc- tion of a shoofly track extending across the Southeast Anaheim Channel. The City would normally reimburse said Flood Control District for its increase in cost to provide a crossing for the shoofly track; and WHEREAS, Orange County Flood Control District and the City of Anaheim are agreed that said Flood Control District's increased cost to meet the City's shoofly requirements is approx- imately equal to the City's cost of relocating the 10 -inch water line; and WHEREAS, the parties desire to enter into an agreement providing that each will do the work required by the other party in its proposed construction, more particularly hereinabove described, at no cost to the other party. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that an agreement be made and entered into by and between the City and Orange County Flood Control District providing that the City will relocate its 10 -inch water line in Howell Street at no cost to Orange County Flood Control District, and that Orange County Flood Control District will construct a railroad culvert to City's shoofly requirements at no cost to the City. BE IT FURTHER RESOLVED that the Mayor and City Clerk be, and they are hereby authorized to execute such agreement for and on behalf of the City of Anaheim.
